Approval of 1915(c) Waiver Amendment
The Centers for Medicare and Medicaid Services (CMS) approved The Office for People With Developmental Disabilities' (OPWDD) application for amendment to the 1915(c) Home and Community-Based Services Waiver. The amendment and its provisions take effect today.

We have been anticipating these changes and discussing them with our Executive Directors on our weekly calls. The approved waiver amendment includes: 
  • revisions to the rate setting methodology for calculating the occupancy adjustment, Vacancy Days, Therapy Days, and Retainer Days for Supervised Residential Habilitation services;
  • alignment of Community Prevocational Services rate setting regions with the regions already in use for Community Habilitation;
  • updates to the Community Habilitation description to implement clinical review tools for consistent and efficient decision-making, fairness and equity of service authorizations for Community Habilitation, 
  • and technical changes to streamline the completion of the Documentation of Choices form by eliminating the need for Care Managers and Regional Office staff to sign the form.
Our multi-pronged advocacy campaign opposing the significant cuts included in the amendment continues. You can take action by contacting state leaders through our online advocacy platform to call for adequate funding for supports and services for people with I/DD.

Willowbook Class Individual Return to Day Program
OPWDD's Acting Statewide Willowbrook Liaison, Angie Francis, reported the following process for getting approval for Willowbrook individuals to return to day program. This process, outlined below, applies to all Willowbrook class members.
  1. The day program agency needs to follow the guidance for Day Program reopening as issued by OPWDD and submit required attestation and safety plan. DQI maintains a tracker of this.
  2. The Care Manager needs to have a meeting to review and discuss the safety plan and any needs of the individual. The notes need to provide detail about what was discussed and exactly how all of the health and safety needs of the person are going to be met including transportation as well.  
  3. The meeting note(s) and recent Life Plan need to be sent to Angie Francis at OPWDD. Contact information is available below. 
  4. If the day program is listed on the DQI tracker as having all of the necessary pieces, Angie Francis will follow up with CAB and Plaintiff's Attorneys to provide them the CM meeting note(s) and LP and wait for their approval for the individual to return.
  5. If the day program has not submitted their required documents to DQI, it will need to do so before OPWDD can follow up with CAB and/or Plaintiff's Attorneys.
  6. If CAB and Plaintiff's Attorneys have additional follow up questions, etc., OPWDD will send them back for the CM to follow up on.

Bonadio Leadership Institute Presentation
The Arc NY Leadership Institute held a session on Tuesday exploring the key financial metrics a CEO needs to monitor and how a CEO can merge those metrics with mission-based operational leadership. Presented by Gerry Archibald and Terry Phillips of the Bonadio Group, the session will be helpful to anyone who is an executive leader in our field.
