COVID-19 AND YOUR LAND USE APPROVALS—DON’T DELAY PROTECTING YOUR RIGHTS

We hope this email finds you and your family healthy and safe during these turbulent times.  

While no one can predict how COVID-19 ultimately will impact our public health, its economic effect may – at least in the short term – mirror that of the last recession.  

In an effort to proactively protect client’s land entitlements, the real estate attorneys at Obermayer have issued a call to the Governor and members of the Legislature in Harrisburg to pass emergency legislation similar to that in 2010, which extended the time periods to start and complete our projects under all governmental approvals.  There is no assurance that they will do so again.

Do not to assume that the time periods applicable to your zoning, land development and other vital permits and approvals will be extended during – and after – this crisis.   We strongly advise you to review all of your permit and approval deadlines and, if necessary, act now to preserve your rights.   Our real estate team is available to analyze approvals and permits, calculate deadlines, and take whatever steps are necessary to confirm that your entitlements do not lapse during this difficult time. 

We will continue to keep you informed of our efforts to encourage the passage of comprehensive permit extension legislation. Until there is action, we stand ready to assist you and your real estate business navigate the likely economic downturn.
