Senate version of HB 3 Clean-Up Bill threatens school funding
The Senate Education Committee adopted a committee substitute and passed CSHB 1525 out of committee on Tuesday. The bill is not yet reported out of committee, but you can view the text of the bill here. The Senate's CSHB 1525 would place on a cap on the total Formula Transition Grant funding, which would trigger proration and funding reductions for FTG districts if the total amount required exceeds $400 million. CSHB 1525 would also allow the Commissioner to "adjust" (meaning reduce) school district entitlements to ensure state compliance with MOE and MOQ requirements in the federal legislation. Additionally, the bill would require all districts that receive federal ESSER dollars (we're told this will apply only to those who received $500,000 or more from ESSER) to set aside an amount from state and local M&O funding equal to 40% of their total federal ESSER allocation in the district's fund balance which may not be used until 2024-25 without special permission from the Commissioner to do so.

This is a matter that impacts all school districts. We are concerned that the state would be requiring local districts to supplant funding at the local level in a manner that sets up an easier road to state funding cuts for schools when the Texas Legislature convenes in 2023. Federal COVID Relief dollars should be used on top of school district funding entitlements -- not instead of.

What's happening this week?
Texas House
The House Public Education Committee met Tuesday morning and considered a long list of bills, including SB 28 (Bettencourt/Dutton), which make charter school expansions easier and more available. SB 28 failed to pass in committee.

Another bill that was initially passed by the House, and then later failed on third reading was back today, reconsidered, and passed. HB 4545 (Dutton) requires schools to offer accelerated instruction to students who fail state assessments, and is pretty prescriptive in the requirements. Provisions related to commissioner contract authority and outcomes-based funding were removed.

This week, the House also gave final passage to:
  • HB 3979 (Toth), prohibits districts from accepting donations associated with curriculum/materials that are similar to Critical Race Theory, and also limits teaching on certain topics as well as the offering of class credit for certain activities.
  • HB 547 (Frank), allows homeschooled students to participate in school district UIL activities in district that choose to allow for participation.
  • HB 1568 (Middleton), changes percentages in the study the comptroller conducts to determine the taxable value of all property in each school district. Aggregate local value of all property sampled may not be less than 85% of the lower limit for the margin of effort (current law requires 90%). Comptroller is required to use a margin of effort that does not exceed 7.5% (current law requires 5%).

Today is the final day that a House bill possibly has to make it out of the House. If a HB isn't heard on second reading today (or on the Local Calendar tomorrow), then when the clock strikes midnight tonight, the bill is dead.


Texas Senate
The Senate Education Committee met today to hear the following House bills:

  • HB 129 (González, Mary/Zaffirini) adds “digital citizenship” to the TEKS, which would include cyberbullying, as well as digital ethics, etiquette, safety, and security.
  • HB 159 (González, Mary/Lucio) strengthens training for educators and principals in order to better serve and better educate students with disabilities. 
  • HB 189 (Canales/Lucio) Requires charter schools to follow the same severance payment requirements (and possible penalties) as school districts.
  • HB 1080 (Patterson/Nelson) requires that UIL allow participation from enrolled students receiving outpatient mental health services
  • HB 1133 (Clardy/Hughes) allows the voters of Rusk County decide whether to maintain or revoke the county equalization tax.
  • HB 1342 (Leach/Perry) requires TRS to provide de-identified health information, enrollment information, or other available relevant information upon request to districts seeking bids for alternative health benefit plan coverage
  • HB 2120 (Bell, Keith/Perry) codifies the process by which districts process complaints and grievances.
  • HB 2721 (Lucio/Lucio) bans a student from participating in extracurricular activities or UIL events if the student engages in conduct that constitutes assault against a referee, judge, or other official in retaliation for the official’s actions in performing their duties.

The Committee will reconvene upon adjournment of the Senate today to vote on these bills as well as other pending business.
