CSO Member Newsletter

CSO Members,

I can’t wait to see many of you next week in Duluth for the CSO member meeting. Whether you can attend or not, I hope you will take some time to read through the packet of materials on the members-only webpage, https://www.coastalstates.org/members-only/meeting-materials/ (user: csomember; PW: 100c$omember@@) assembled by CSO staff. This is the most comprehensive review of CSO’s work that we produce all year.

As CSO has grown, we have been able to accomplish more than ever! Including our CSSF staff, we currently have 7 fulltime staff and 3 fulltime fellows (and had 2 summer interns and an extern). In the meeting materials you’ll find:

  • Updates from 6 CSO work groups;
  • Updates on 9 CSO projects;
  • 2 CSO policies to be voted on (1 new, 1 re-fresh), our FY25 approps request, a legislative update, and a regulatory update;
  • And CSO’s proposed 2024 budget – which is our largest annual budget ever!

Let me know if you have any questions, and I look forward to seeing you soon!

Regards,

Derek Brockbank

Executive Director

CZM Competitive Funding using BIL year 2 and IRA funds received about 65 LOIs, totaling ~$175 Million (both similar to last year). Just under $60 million will be awarded this year. Some LOI submissions will be invited to submit a full proposal by early October.

Hill Updates

Appropriations:

The Senate and House are facing the time crunch of reaching an agreement on Fiscal Year 2024 spending in less than 10 days. With bills struggling to make progress on the floor of either chamber and 2 bills in the House (including the Commerce, Justice and Science bill containing NOAA funding) having not yet cleared even the full appropriations committee, meeting that deadline seems nearly impossible. Much of the discussion will now focus on trying to reach an agreement on a temporary stop gap measure to continue to fund the federal government beyond September 30th. If they are unable to do so, we will be looking at a government shutdown.

Other Legislation:

We anticipate several pieces of legislation to be introduced this fall, including the CELCP and NERRS Reauthorization. Rep. Levin's (D-CA) team has recently confirmed that the bill will be co-led by Reps. Mast (R-FL), Rep. Bonamici (D-OR) and Rep. Kiggans (R-VA). Rep. Kiggans is a Freshman member from Virginia who sits on the Natural Resources Committee. We were able to take her staff on a site visit to the Chesapeake Bay National Estuarian Research Reserve-Virginia, last month, so we are very excited to have her come on board to champion this effort. Progress is also being made on updates to the text of several other bills including the Senate version of the NOAA Organic Act, the House National Ocean and Coastal Security Fund Improvement Act and a new bill looking at compensation for the impacts of offshore wind development on fisheries. See all the bills we track on our legislation tracker.

Regulatory Update

See here for the 2023 Fall regulatory summary. More information on rulemaking developments is available on the Regulatory Resources page.

[NEW] EPA Releases Text of § 401 Water Quality Certification Final Rule

In Sep. 2023, EPA issued a prepublication edition for a final rule modifying Clean Water Act § 401 state water quality certification regulations. The final rule repeals certain 2020 regulatory changes, defines the scope of review as the water quality-related impacts from the entire activity subject to the federal permit, including construction and operation, and set a default six-month review time limit. An EPA summary fact sheet is available. The final rule is largely consistent with the feedback CSO (and allies) provided on the June 2022 proposed rule; a crosswalk of CSO’s comment and the final rule is available here.

CEQ Issues NEPA “Phase 2” Rule – Deadline 9/29

On Jul. 31, 2023, the Council on Environmental Quality (CEQ) issued a National Environmental Policy Act (NEPA) Implementation Regulations Phase 2 proposed rule. Significant changes under the proposed rule include a codified definition for “environmental justice” that calls for more explicit consideration of impacts on burdened communities, requiring assessment of both the impacts of the proposed action on climate change as well as reasonably foreseeable effects of climate change on the proposed action, broadening consideration of context and intensity to include multiple geographic and time scales, and creating greater flexibility for agencies to promulgate and use categorical exclusions. The Rule also invites agencies to pursue “innovative approaches” to NEPA compliance when addressing “extreme environmental challenges” due to climate change. A redline of changes from current regulations under the proposed rule is available here. Virtual meetings will be held in late August and September. Comments may be submitted via Regulations.gov through Friday September 29, 2023.

DOE CITAP Transmission Review Process Rule Proposed – Comment deadline Oct. 2, 2023

On Aug. 16, 2023, the Energy Department issued a proposed rule to streamline the federal permitting process for high voltage transmission lines. The new regulations apply to non-marine interstate transmission projects carrying greater than 230kV which require a NEPA Environmental Impact Statement. Proponents of offshore grid projects (not generation export cables) can also request to use the accelerated process. Comments can be submitted via Regulations.gov through Monday October 2, 2023.

EPA Clean Water Act 404 Assumption Rule Proposed – Comment deadline Oct. 13, 2023

On Aug. 14, 2023, EPA formally issued a proposed rule to revise the process for states and Tribes to administer Clean Water Act Section 404 dredge and fill permitting programs, after releasing a July prepublication copy. Elements of the proposed rule include clarification of retained waters, compensatory mitigation requirements (allowing banks and permittee mitigation but not in-lieu fees), and five-year permit limits. Public comment may be submitted via Regulations.gov through Friday October 13, 2023.

FEMA Announces FY22 BRIC and FMA Selections

On August 28, 2023, FEMA announced the selection of 124 projects for this year’s BRIC National Competition. In addition, this is a follow-up from May 19, when FEMA announced the BRIC initial selections for the Tribal Set-Aside and the State and Territory Allocation. FEMA made $2.295 billion available for the Building Resilient Infrastructure and Communities (BRIC) grant program in fiscal year 2022. BRIC received 803 subapplications totaling more than $4.6 billion from 55 states, territories, and the District of Columbia. The agency also received requests from 37 tribal governments totaling more than $56.2 million in the Tribal Set-Aside funds. Learn about the application process here and see the selected projects here.

NOAA Brennan Ocean Mapping Matching Fund

NOAA invites non-Federal entities to partner with NOAA National Ocean Service’s ocean and coastal mapping programs on jointly funded projects of mutual interest. NOAA would receive and match partner funds and rely on its existing contract arrangements to conduct the surveying and mapping activities in FY2025. Cost share is 70% federal / 30% non-federal up to $1M total. Proposals must be submitted via email to iwgocm.staff@noaa.gov. Proposals, including any optional GIS files of the proposed project areas, must be received via email by 5 p.m. ET on Tuesday October 10, 2023. If an entity is unable to apply but has an interest in participating in similar future opportunities, NOAA requests a one-page statement of interest, also by October 10, 2023. Virtual office hours will be held Sep. 14, 2023; register by email.

Request for Proposals on Including Indigenous Ways of Knowing in Decision-Making for Ocean and Coastal Management

The Lenfest Ocean Program has released an RFP for projects that elevate Indigenous Peoples in sharing their traditions, culture, knowledge, and wisdom to improve evidence-based decision-making for the management, conservation, and restoration of coastal marine species, habitats, and ecosystems. The RFP is intended to support identification, analysis, and/or communication of Indigenous Knowledge and wisdom (where it is culturally appropriate); and engagement approaches that facilitate the inclusion of this knowledge into ocean and coastal management decisions. The deadline to apply is Monday October 16, 2023.
