Even though Congress only just passed its FY26 budget, it will soon start the FY27 budget process. While we fully expect the budget process to go past the election, NOW is the time to reach out to your members of Congress. If you can, we strongly encourage you to submit budget requests with your offices - simply asking for funds is the most important step! For those coming to DC for the member meeting, please start setting up Hill visits. Finally, if you have restrictions on lobbying, please consider sharing stories of how you spend existing appropriations; and if only your legislative affairs team can meet with congressional offices, please share CSO's funding request and give talking points about your CZM program to your leg team.

Member-to-Member Requests

USACE Permits for Dam Removal

The Maine Coastal Program has requested to hear from coastal states and territories on these questions about dam removals:

  1. Does your jurisdiction have a USACE general permit that allows dam removals as part of restoration activities?
  2. Does your jurisdiction have any other kind of agreement with USACE to streamline processing dam removals as part of restoration activities?
  3. Are you aware of any programmatic agreements between a USACE district in your jurisdiction and NMFS to streamline Endangered Species Act Section 7 consultations (not necessarily limited to dam removals)?

 

Please share any and all relevant information with Erin Wilson (erin.wilson@maine.gov) and cc John Ryan-Henry (jryan-henry@coastalstates.org) for archiving. Responses are requested by Friday, March 13.


Federal Consistency Forum

The kickoff call for the new quarterly federal consistency member discussion space called Fed Con Forum was held on Monday, January 26 - the next call is scheduled for Monday, April 27th. If you are interested in participating, please reach out to erin.wilson@maine.gov and jennifer.holmes@delaware.gov.

Expanded Member Directory

CSO is expanding our existing CZM program staff directory to identify points of contact for 20+ topics/issues. CSO staff will use these "point of contact" lists to get feedback on bills and rulemakings, and to share announcements and news. You can use them similarly - as a peer community of practice for questions and conversation on the relevant topic.


Action needed: Please take 2 minutes to review/update your own contact info in our directory and add the topics for which you would like to be included. Click here: CSO Directory Update. (CSO Delegates and Alternates have the ability to edit and add topics for ALL the staff in their program, everyone else can only edit their own contact information - this is automatic when you enter your email address.)

Hill Updates

Coastal Trust Fund Act

Rep. Van Drew (R-NJ), along with Rep. Gillen (D-NY) intends to introduce a new bill, the Coastal Trust Fund Act, next week. This bill would establish a federal trust fund, which would provide up to $1 billion a year to support Army Corps Coastal Storm Risk Management Projects, including beach nourishment. This Trust Fund would make use of existing offshore energy lease revenues, which currently just go back to the U.S. Treasury. Projects drawing on this Trust Fund would have to be authorized through the Water Resources Development Act and appropriated. 


CSO intends to support this legislation. While funds would not go directly to states, this legislation would help to reduce the backlog and current unmet funding need for beach projects that would benefit states and local coastal communities. 


Coastal Communities Caucus Briefing on Beach Nourishment

Last week, CSO was asked by Rep. Min (D-CA) to speak on a panel for a House Coastal Communities Caucus briefing on beach nourishment. Derek Brockbank joined Joan Pope (ASBPA), Dan Ginolfi (American Coastal Coalition), Dr. Brett Sanders (UC Irvine) to speak about the need for increased federal support of beach nourishment. The discussion was facilitated by Rebecca Dennis. More than 45 congressional staff joined the briefing.   


FOR ACTION: 2026 Coastal Hill Day - March 3rd

Our annual Coastal Hill day is officially less than one month away! If you are planning to meet with your state's Congressional delegation, it would be good to start thinking about reaching out in the next week or two to offices to set up those meetings. As always, CSO will provide talking points on key issues and are happy to strategize with you about how to approach your meetings. If you need contacts in offices or help setting up meetings, please let Rebecca Dennis (rdennis@coastalstates.org) know as soon as possible.  


For those coming from the Great Lakes, that is also Great Lakes Week, so I would encourage you to reach out ASAP as those offices and staff will be in high demand!



FOR ACTION: Appropriations and community project funding requests

Congressional offices are beginning to turn their attention to FY 2027 appropriations. States, and your local partners have the opportunity during this time to submit requests for FY 2027 appropriations for Coastal Management Grants, as well as for community project funding (earmarks for specific CZM related projects). This community project funding could be a great option for individual projects you or your partners are looking to get funded. If you or your partners are planning to submit community project funding requests, let us know, so that we can help elevate those asks with members. 


To help with this process, CSO is working with other DC partners to crowdsource links to request forms and deadlines. We will keep this spreadsheet updated with the latest info that we have. 

Regulatory Updates

Executive Order & SBA Rule Seek to Preempt State/Local Codes

 On Jan. 29, the Small Business Administration (SBA) issued an interim final rule purporting to preempt state and local permit requirements for "real property repairs, rehabilitations, replacements, or any associated activities financed in whole or in part by an approved SBA Disaster Loan." The new rule applies immediately to SBA disaster loans approved since the beginning of last year. Comments may be submitted via Regulations.gov through Mar. 2, 2026.

 

The E.O. and SBA's interim final rule assert an aggressive claim of federal preemption supported by only nominal legal justification. States and local governments will have a strong legal basis to challenge the interim final rule or any private development action that relies on it. Pursuant to Executive Order 14377, FEMA is ordered to issue a proposed rule with similar effect by Feb. 23.

National Shoreline Management Study - Pacific Islands and Commonwealth Regional Assessment

Our U.S. Army Corps of Engineers (USACE) National Shoreline Management Study (NSMS) team is pleased to announce that the final NSMS U.S. Pacific Islands Regional Assessment report is available to download. The NSMS regional assessments represent a USACE-led collaborative effort, highlighting the physical, economic, environmental, social, and cultural impacts of shoreline change that result from natural and human-induced influences on coastal processes across every coastal region of the United States. NSMS reports provide national and local government policymakers, coastal scientists and engineers, academia, indigenous peoples, Tribal nations and representative groups, and other coastal interests and decision-makers key findings and recommendations regarding erosion and accretion and their causes. Boat US Foundation - Capturing Abandoned and Derelict Vessels across the US, Freely Associated States, and US Territories

The BoatUS Foundation for Boating Safety and Clean Water has developed this reporting database to identify and track Abandoned and Derelict Vessels (ADVs) in the United States, Freely Associated States and U.S. Territories. BoatUS Foundation is collecting information, through individual reports, to understand the scope of the problem of ADVs and track prevention and removal efforts by states and partners. ADVs pose navigation, safety, and pollution hazards to the communities where they are located. With your help, we can understand this issue better and work together towards solutions that prevent future ADVs. This project was made possible and supported by the National Oceanic and Atmospheric Administration Marine Debris Program. Learn more here.


Funding Opportunity: Climate Smart Communities Initiative

CSCI awards provide funding and technical assistance to advance community-based climate resilience in US communities or regions that are highly vulnerable to the impacts of climate change. The total grants budget is $1.5-2 million and grants typically range from $75,000 to $115,000 based on the scope of work proposed in the application. CSCI anticipates awarding between 16-20 grants for the 2026 cycle. The program prioritizes funding for communities that include historically disinvested populations at increased risk to climate-related impacts. It is open to US-based project teams composed of a climate adaptation practitioner and representatives from a local or regional government entity and a community-based organization. The application deadline is March 12, 2026. Learn more here.


Great Lakes Climate Adaptation Resource Guide

For hundreds of small and medium-sized communities across the Great Lakes region, preparing for the water-related impacts of changing weather patterns can be challenging. The International Joint Commission’s (IJC) Great Lakes Water Quality Board has developed a new Great Lakes Climate Adaptation Resource Guide. The guide highlights tools and approaches (including the CALM community of practice!) to help communities integrate Great Lakes water topics into their climate adaptation and resilience strategies. Coastal Southeast Technical Assistance Application

For those that haven't heard, the Coastal Stormwater Center of the Southeast (CSC) is one of four EPA-funded Stormwater Centers of Excellence across the U.S. The Center for Watershed Protection is honored to lead the CSC alongside an incredible team of partners: University of Florida, East Carolina University, North Carolina Coastal Federation, Clemson University, Virginia Tech, University of Georgia, and Auburn University. Through the CSC, we'll be offering technical assistance at no cost, to state, Tribal, and local governments and environmental non-profits tackling stormwater challenges across coastal VA, NC, SC, GA, FL, and AL. This is just one of the many initiatives we’ll be rolling out to support resilience and innovation across the region. Learn more here.


Funding Opportunity: $1.45 Billion in Supplemental Economic Funding Available for Disaster Recovery

The United States Economic Development Administration has announced the Notice of Funding Opportunity (NOFO) for its Fiscal Year (FY) 2025 Disaster Supplemental Grant Program. This program makes approximately $1.45 billion available to areas that received major disaster declarations in the calendar years 2023 and 2024 for economic recovery activities. Funds can support both construction and non-construction projects. State and local governments, Native tribes, higher education institutions, public or private non-profit organizations that work with local government, economic development organizations, and public-private partnerships for public infrastructure are eligible. The EDA will fund up to 80% of the project with higher percentages available for severely distressed applications and Tribal organizations. Applications are accepted on a rolling basis until funds are spent for Readiness and Implementation path projects, while Industry Transformation grants will be due March 3, 2026.
