The Claims Basics (Funding Entity) Pre-Session will focus on the following issues:

  • A discussion of the claims process and legal terminology
  • Reserving/Accounting GAAP v STAT
  • May include medical underwriting

Fundamentals of Trusts
12:00pm - 1:30pm EST
A presentation examining the historic, traditional, and modern uses of trusts, with special emphasis on the special needs of the beneficiaries for whom they are created. Tax and non-tax reasons for use of trusts will be explored.

Insurance Companies: Regulations & Structure

The Insurance Companies: Regulations and Structure” Pre-Session will focus on the following issues:
  • The structure of insurance companies and how they are  regulated (why these companies are strong)
  • Licensing & Appointments (primary structured settlement consultant)
  • General Highlight of Life Company Insolvency/RBC risk discussion (no “in the weeds” talk)
  • Ratings Services/Fees
  • Actuarial Analysis/Overview

Tax Codes 101

A fundamental knowledge of the taxation of damages and the doctrines that impact structured settlements are essential for doing business in today’s ever more complex world.

Emphasis on what currently constitutes a physical injury, and associated tax doctrines like constructive receipt and economic benefit will be covered. Sections 104, 130, 451 and 5891 of the Internal Revenue Code will be addressed.

Document Review and Process
(Words Matter)

The "Document Review and Process (Words matter!)” Pre-Session will review the best practices in the completion of standard structured settlement documents and attempt to answer the central questions of why certain language needs to be included and will also cover common pitfalls to avoid during document preparation.

Non-Qual Cases + Attorney Fees

 The “Non-Qualified Cases and Attorney Fees,” session is to compare what makes a case “non-qualified” and review common examples, and provide attorney fee basics.
