California News

- AB 2100 (Wood) unanimously passed the Assembly Health Committee and is now headed to the Appropriations Committee. In the speed with which this bill seems to be moving, you are encouraged contact the members of the committee today, to urge the passage of AB 2100. AB2100 would make the necessary changes to Medi-Cal's administration of the pharmacy benefit to its beneficiaries, in line with Governor Gavin Newsom's objective of moving the pharmacy benefit out of Medi-Cal Managed Care and into fee-for-service (FFS) without causing undue harm or burden to patients. AB 2100 also corrects the "below-acquisition cost" reimbursement issue caused by the newly adopted methodology mandated by the Affordable Care Act in 2016 and prevents the state from further implementing any 'clawbacks' of claims going back to May of 2017. Please reach out to the members of the Assembly Appropriations Committee to vote YES on AB 2100.

- The list of Gov. Newsome's proposed budget cuts is lengthy. Physicians, dentists and other health care providers who treat Medi-Cal patients also stand to lose $1.2 billion in supplemental Medi-Cal payments that flow from Proposition 56, a tobacco tax that voters approved in 2016. In general, he is wanting to scale back or eliminate programs intended to keep low-income seniors and people with disabilities in their own homes. He proposes to make it easier for the state to collect posthumous payback from deceased Medi-Cal enrollees 55 and older for a broad range of medical costs through the controversial "Estate Recovery Program." He suggests reinstituting stricter income requirements for some older people and those with disabilities to qualify for free Medi-Cal.  Whether lawmakers will make the sweeping Medi-Cal cuts the governor has proposed is uncertain. For example, the state Senate plan preserves Medi-Cal funding and assumes Congress will pass another stimulus bill. Both houses of the legislature must come to an agreement and present their version of the budget to the governor for consideration by June 15.

- The California State Senate adopted a budget plan that rejects Gov. Newsom's cuts to Medi-Cal and other health care services. The state Assembly is poised to follow suit later this week. Read CMA President Peter N. Bretan, M.D.'s statement on the legislative plans here.

- State workplace safety regulators have received about 30% more complaints against California employers at this time of the year compared to the same period last year, according to data obtained by The San Francisco Chronicle through a public records request. The surge in complaints stem from coronavirus complaints, said Frank Polizzi, a spokesman for the California Division of Occupational Safety and Health.

National News

- The Trump administration is renewing a push to end unexpected bills for out-of-network care, possibly as part of the next pandemic relief package. Under a proposal being explored, health care providers would be prohibited from billing patients for thousands of dollars in out-of-network care, and billing disputes would be resolved on a case-by-case basis.

- The House of Representatives passed a bill this week that will provide flexibility for Paycheck Protection Program (PPP) loans.

- Legislation meant to thwart "frivolous litigation" targeting health care providers who made "good faith" efforts to provide care during the COVID-19 pandemic has been introduced by Reps. Lou Correa, D-Calif., and Phil Roe, R-Tenn. Care that involves gross negligence or willful misconduct would still be subject to litigation.

-  Get Ready for the Evaluation and Management Changes in 2021 . On January 1, 2021 significant changes will be coming to the office and outpatient Evaluation and Management services. Begin the process of preparing your practice with these three steps:
For questions regarding the changes (or any other billing and coding questions) contact ASCO staff at billingandcoding@asco.org.

- A digital pre-visit checklist provided to patients before telehealth appointments improved efficiency of virtual visits . Though the Journal of Bone and Joint Surgery wrote the paper for orthopedic care at Massachusetts General Hospital, its application can be utilized to success across all specialties utilizing virtual health care. The checklist directs patients to a website to test their camera and microphone settings; guides patients through camera setup, location and lighting; advises them on the best clothing to wear to facilitate a virtual exam; and provides pictures of complex maneuvers.

- Compliance with evidence-based clinical pathways rose from about 58% over a six-month period to 72% at nine community-based oncology practices in Texas that integrated a physician-designed clinical decision support tool into their EHR systems , according to a study presented at the American Society of Clinical Oncology's annual meeting. The CDS tool nudges physicians instead of forcing action, and it effectively improved compliance targets broadly and at the individual clinician level, researchers found.

- A study published in JAMA Network Open showed EHRs consistently fail to detect up to one-third of dangerous drug interactions and medication administration errors in hospitalized patients. Researchers used an EHR safety evaluation tool to feed simulated medical records into EHRs at 2,314 US hospitals, and the EHRs correctly flagged potential drug problems 66% of the time in 2018, up from 54% in 2009.

- COA has released the 2020 Community Oncology Practice Impact Report , which tracks the changes and shifts of community oncology care in the United States. This year's report shows that the last 12 years have been host to closures, financial struggles or mergers, with a 20.8 percent increase in mergers since the last Practice Impact Report in 2018. Other data points include: 435 clinics closed; 348 practices struggling financially; 40 practices sending patients elsewhere; 722 practices acquired by hospitals; 203 practices merged or acquired.

- If you missed The Financial Impact of COVID-19: Bankruptcy 101  presented by: Svetlana (Lana) Ros, Esq. - Member, Healthcare Practice Group at Norris McLaughlin, P.A. and Bruce J. Wisotsky, Esq. - Member, Bankruptcy & Creditors' Rights Practice Group at Norris McLaughlin, P.A. below are the following:
-  Providers Must Act on Application for Provider Relief Fund by June 3 ;  HHS' Extends Attestation Deadline.
Background : $50 billion from the Provider Relief Fund has been allocated by Health and Human Services (HHS) for general distribution to Medicare facilities and providers impacted by COVID-19. To be eligible for the general distribution, a provider must have billed Medicare in 2019. To expedite providers getting money as quickly as possible, $30 billion was distributed immediately, proportionate to providers' share of Medicare fee-for-service reimbursements in 2019. HHS subsequently announced that the agency would begin distribution of the remaining $20 billion of the Fund to providers to augment their allocation so that the whole $50 billion general distribution is allocated proportional to providers' share of 2018 net patient revenue. A portion of providers were automatically sent payment based on the revenue data they submitted in CMS cost reports. Providers without adequate cost report data on file need to submit their revenue information through an application portal on the HHS website. (HHS will likely have cost reports from facilities, but physicians and other providers may need to submit information through the portal.)
IMPORTANT NOTE - HHS has twice extended the deadline for attestation of acceptance or rejection of provider relief funds, but these extensions do not affect theapplicationdeadline for the second tranche of the general distribution.
Providers will have until June 3, 2020 to access the application portal to submit their revenue/loss information, at which time the application portal will close.
In order to enter the application portal, providers must accept or reject the first distribution of funds. By June 3, 2020, if a provider has not yet decided whether to accept the funds they have already received, they may reject the first set of funds and submit their revenue/loss information to the application portal for consideration. The provider will be reallocated all General Distribution funds they are owed based on their submitted application and will then have 90 days to attest or reject.

CMS News

- Medicare beneficiaries using telehealth rose from around 11,000 the week of March 7 to 1.3 million the week of April 18, according to claims data. Another survey of 1,000 Medicare Advantage members revealed that 24% of Medicare Advantage subscribers said they had used telehealth since the coronavirus pandemic began. 52% said they would be comfortable using telehealth. The survey, commissioned by the Better Medicare Alliance, found 91% of those who used telehealth during the pandemic had a favorable experience and that 99% overall were satisfied with their Medicare coverage. Avalere's Tim Epple said the uptick represents "five to 10 years of progress taking place in a month and a half," and CMS Administrator Seema Verma says the agency might extend telehealth coverage waivers.

- CMS hosts varied recurring stakeholder engagement sessions to share information related to the agency's response to COVID-19. These sessions are open to members of the healthcare community and are intended to provide updates, share best practices among peers, and offer attendees an opportunity to ask questions of CMS and other subject matter experts.

- Join the Chronic Care Policy Alliance tomorrow, Wednesday, June 3 at 10:30 AM PDT, for a webinar on the State of Chronic Care: How a New Federal Rule will Increase Prescription Drug Costs for Patients. A Policy Discussion for Advocates. Discussion will be on how a federal policy change will leave many patients facing higher out-of-pocket costs for their prescription medications. The recently released 2021 Notice of Benefit and Payment Parameters (NBPP) allows private health insurers to exclude certain co-pay assistance programs, such as cards and coupons, from counting toward deductibles and out-of-pocket maximums. As a result, patients will no longer be able to rely on these critical programs and face increased costs. Federal health policy and advocacy expert Carl Schmid, will provide an overview of the NBPP rule change and key insights into the impact it will have on patients with chronic disease. Learn more about: The vital importance of co-pay assistance to keep medications affordable; Co-pay accumulators and how they work; Why this change to the NBPP is harmful for patients; What CCPA is doing to advocate for patient rights and patient access; How your organization can help keep prescription medicine affordable.  REGISTER HERE!
