This Weekly's Hot Topic

- You know the saying, the only two certainties in life are death and taxes. Well, today, April 16, National Healthcare Decision Day comes on the heels of tax day. Organized by the Conversation Project, an offshoot of the Institute for Healthcare Improvement, it's a day designed to highlight the importance of advance planning and to "encourage patients to express their wishes regarding healthcare and for providers and facilities to respect those wishes, whatever they may be." According to a 2017 study in Health Affairs, only 36.7% of Americans have an advance directive.

National News

The difference between death and taxes is death doesn't get worse every time Congress meets. Will Rogers, actor humorist, social commentator.

- In a major test case, Medicare is poised to cover a promising but expensive new type of cancer treatment, with significant restrictions meant to hold down the cost. Cancer patients, doctors and drug companies are urging the Trump administration to remove the restrictions and broaden coverage so more patients can benefit from the treatment, known as CAR T cell therapy, or CAR-T. But insurance companies are pushing for the restrictions.

- The House Ways and Means Committee has cleared a proposed amendment to the Physician Payment Sunshine Act that would require manufacturers and suppliers to report to the CMS the value of any samples of medical devices, drugs and biologicals they give to physicians. This could include samples used for educational purposes. Medtech Insight

- The Comprehensive Addiction and Recovery Act of 2016 required the U.S. Department of Health and Human Services to create a task force to identify gaps or inconsistencies, and propose updates to best practices and recommendations for pain management, including chronic and acute pain. READ MORE

- A bipartisan bill that aims to stop "evergreening," a practice drugmakers use to extend monopolies by obtaining additional patents on minor drug changes, has been introduced by Sens. Dick Durbin, D-Ill., and Bill Cassidy, R-La. "The REMEDY Act will increase competition and help reduce drug costs," Durbin said. Axios ,

- Earlier this month, the House Subcommittee on Health, Employment, Labor, and Pensionshearing resulted in a bipartisan agreement on the issue of surprise medical bills that result when patients go to hospitals that are outside their insurance network: The bills have got to go. More than half of states provide consumer protection from unexpected out-of-network charges, but most of the laws aren't comprehensive. The result is a bipartisan public policy problem in need of a federal solution. The House subcommittee discussed possible legislative solutions, such as placing caps on how much out-of-network providers can charge, relying on doctors and insurers to determine payments within set parameters and the like. With bundling, patients would receive a single in-network bill, then hospitals would negotiate with specialists to determine how much they are paid. Industry representatives from hospitals and insurance companies are pushing back on specific proposals, but there is widespread agreement that any solution must protect patients and keep them out of billing negotiations. President Trump has also called the issue a priority, and legislation is expected to pass sometime this year.

- Introduced last week in this publication, pharmacy benefit managers are undergoing increased scrutiny. Two lawmakers have asked the Health and Human Services inspector general to investigate so-called spread pricing practices by these pharmaceutical middlemen as part of a larger inquiry into rising drug costs. In an April 8 letter released on April 10, the heads of the Senate Finance Committee pointed to instances where PBMs have purportedly used this practice to make millions of dollars in excess profits at the expense of state Medicaid programs. Spread pricing is a crucial but little-known part of the opaque pharmaceutical pricing system and refers to fees PBMs pay pharmacies and bill back to Medicaid. Stat: Lawmakers Ask The Trump Administration To Investigate PBM Pricing

- In a related story, as Washington lawmakers struggle to find ways to lower drug costs, a new survey finds that a sizable proportion of employers support proposals to eliminate the rebates paid by drug makers to win favorable insurance coverage. Stat: Many Employers Would Like To Drop Controversial Rebates On Drugs .
- The Centers for Disease Control and Prevention (CDC) issued a key clarification on its Guideline for Prescribing Opioids for Chronic Pain . The clarification comes as a result of a collaborative effort by ASCO, ASH, CDC, and NCCN to clarify CDC's opioid prescribing guideline to ensure appropriate implementation for people with cancer, cancers survivors, and patients with sickle cell disease. - With the increase utility of telemedicine in oncology, more connectivity capabilities with patients is always a consideration. Anelto Health has launched HomeAssure, a senior care solution that uses cellular connectivity from AT&T to monitor patients remotely, while built-in alerts, questionnaires and a 24/7 call-center service aim to cut down on unnecessary hospital trips. HomeAssure comes with an app that allows family members and friends to keep in touch and track patients' activity. MedCity News .

- ASCO submitted comments on drug pricing to the Senate Committee on Finance  focused on concerns about the negative effects of certain PBM practices on patients and the cancer care system. These concerns include errors in filling prescriptions, treatment doses being altered without consultation with oncology care providers, duplicate patient copays due to incomplete dispensing, and drug waste resulting from incorrect doses or treatments being sent directly to a patient's home.
