In a word, as a man is said to have a right to his property, he may be equally said to have a property in his rights. Where an excess of power prevails, property of no sort is duly respected. No man is safe in his opinions, his person, his faculties, or his possessions.

~ James Madison

Happy Birthday, America.

We are indebted to the Founding Fathers for placing a high value on an individual’s right to own property, a right that was a guarantee of liberty.

Fast forward to today.

Many politicians and regulators have steadily eroded the rights of owners and have imposed an onerous regulatory regime best approached with proper counsel.

Notwithstanding our earlier message that the political rhetoric often falls squarely on the side of tenants, there are some victories for housing providers from time to time.

One such flicker of hope is that the U.S. Supreme Court has ruled cities are allowed to enforce bans on sleeping in public spaces, improving the quality of life for residents in the housing community.

How municipalities will react to the high court’s decision is a story yet to unfold.

IN THE MEDIA

We chime in on a “family mess” surrounding a Russian Hill property that was sold for a ridiculously low price.

We are heavy consumers of news germane to rental housing providers and sometimes, we get injected into the stories we read.

We tell the San Francisco Chronicle that an absurdly lengthy lease appears to be valid and barring an Ellis Act eviction, the occupants cannot be removed by a new owner.

This leaves the option of effectuating a voluntary vacancy, a core practice of our law firm.

Let’s continue the thread on voluntary vacancies. Watch an oldie but goodie.

Although this video was aired during the COVID era and some of the information is dated, our core approach in entering into these negotiations has not changed.
