Connecticut (S  1502 a)

On October 31, 2017, Governor Malloy signed Senate Bill 1502a into law which reinstates principal photography shooting requirements for motion pictures and broadens the pool of users of production tax credits. Details are as follows:
  • Requires that a qualified motion picture production to shoot 25% or more principal photography days within an in-state facility that received at least $25 million in private investment and opened for business on or after July 1, 2013.
  • Allows the business tax assessed on community antenna television systems and one-way satellite transmission, under Chapter 211, to be offset by production tax credits as follows:
    • For taxable year beginning January 1, 2018:
      • Allows 92% of the amount stated on the production tax credit voucher to be claimed against the tax imposed under Chapter 211 if the transferee has common ownership of at least 50% of the qualified production company (transferor).
    • For taxable years beginning on or after January 1, 2019:
      • Allows 95% of the amount stated on the production tax credit voucher to be claimed against the tax imposed under Chapter 211; and,
      • If there is common ownership of at least 50% between the transferee and the qualified production company (transferor), the transferee may only claim 92% of the amount stated on the production tax credit voucher.

Pennsylvania (H 542)

On October 30, 2017, Governor Tom Wolf signed House Bill 542 into law thereby creating criteria for film production tax credit districts and establishing the Entertainment Economic Enhancement Program (EEEP). The EEEP provides for transferable tax credits for concert touring and rehearsals. Details of the programs are as follows:
  • Provides criteria for the Department of Revenue to establish not more than two film production tax credit districts for enhancing, promoting and expanding the film production industry within Pennsylvania.
  • For qualified concert tour and rehearsal expenses incurred or to be incurred after July 1, 2017:
    • Allows for a transferable tax credit of:
      • 25% for concerts at two Class 1 venues or a Class 1 and a Class 2 venue in Pennsylvania;
      • 30% for concerts at a Class 1 and Class 3 venue in Pennsylvania;
      • 35% for concerts at a Class 1 and Class 3 venue in Pennsylvania which does not serve alcohol;
    • Allows for an additional 5% for concerts at two or more Class 2 or Class 3 venues;
    • Establishes a per tour incentive cap of $800,000;
    • Must meet all the following minimum rehearsal and tour requirements:
      • Purchase or rental, from a Pennsylvania vendor, of at least $3 million of tour equipment must be delivered to a location in Pennsylvania;
      • Rehearse at a qualified rehearsal facility for a minimum of 10 days;
      • Perform at least one concert at a Class 1 venue; and,
      • Perform at least one concert in a municipality other than the municipality in which the Class 1 venue is located;
    • Incur at least 60% of all rehearsal expenses in Pennsylvania;
    • Limits the qualifying compensation paid to individuals or entities representing individuals to $2 million in the aggregate;
    • Requires the transferee to use the credit in the taxable year in which the purchase is made; and,
    • Restricts the amount of the tax credit that a purchaser or assignee may use against a qualified tax liability to 50% of their tax liability for the taxable year.

Florida (H 341)

House Bill 341 proposes to establish the Florida Motion Picture Capital Corporation, a nonprofit corporation that will function to encourage the shooting of scripted productions within the state of Florida by providing financing to projects that will generate the greatest economic impact to the state. Program highlights are as follows:
  • The amount of production financing provided cannot exceed the amount of the production's in-state expenditures;
  • Establishes a per project financing cap of 12.5% of any uncommitted funds remaining within the Capital account;
  • Preference is given to productions that generate the greatest comparable economic impact to the state;
  • Provides for variable limits on returns that account for the time value and reduce returns in exchange for a production's early buyout of financing positions; and,
  • Requires that at least two application periods per fiscal year be conducted;
    • Each application period may not commit more than 40% of the total funds in the Florida Motion Picture Capital Account. 

Florida (H 409)

House Bill 409 proposes to eliminate the sales and use tax exemption on certain property used in the performance of qualified production services, related to the following:
  • Photography, sound and recording, casting, location managing and scouting, shooting, creation of special and optical effects, animation, adaptation (language, media, electronic, or otherwise), technological modifications, computer graphics, set and stage support (such as electricians,lighting designers and operators, greensmen, prop managers and assistants, and grips), wardrobe (design, preparation, and management), hair and makeup (design, production, and application), performing (such as acting, dancing, and playing), designing and executing stunts, coaching, consulting, writing, scoring, composing, choreographing, script supervising, directing, producing, transmitting dailies, dubbing, mixing, editing, cutting, looping, printing, processing, duplicating, storing, and distributing;
  • The design, planning, engineering, construction, alteration, repair, and maintenance of real or personal property including stages, sets, props, models, paintings, and facilities principally required for the performance of those services above; and,
  • Property management services directly related to property used in connection with the services described above.
