It has been widely reported that the incoming administration may declare a national emergency and use military assets to deport undocumented individuals from the U.S.

Regardless of whether a national emergency is instituted, the President has broad authority to suspend the entry of foreign nationals to the U.S. We experienced this during the prior administration with the Muslim travel ban and the banning of Canadians and other foreign nationals employed in the U.S. during the COVID pandemic. Often these executive orders were signed in the middle of the night and took effect immediately with no prior notice given.

As a result, we are recommending that foreign nationals who plan to travel over the holidays return to the U.S. on or before 1/19/2025 (the day before the presidential inauguration). This includes foreign nationals with valid U.S. visa stamps and valid U.S. immigration status. Further, we are recommending that international travel on and after 1/20/2025 be avoided if at all possible.
