When we noticed that October 3 is National Kevin Day, we laughed and thought, “Wouldn’t it be crazy if we picked that as a theme for this week?” Just check out Kevin McCallister from the popular 1990's Home Alone movies above. But then, why not? The Manely Firm's Lawrenceville Paralegal Karen Perez (pictured here with her brothers at the beach last summer) was excited to hear this was an actual holiday based on her own experience with the name Kevin. Karen laughs and explains, "My younger brothers called me Kevin when they were little because they wished they had an older brother instead of an older sister." Karen continues, "The nickname stuck for years and they'll use it even now in adulthood when they want to tease me..." Now that's funny! Whether you know a Kevin in your life or if you’re named Kevin yourself, we hope you’ll enjoy your own national holiday that celebrates your name!

How did Kevin become a popular name in the first place? When you hear the name Kevin, you probably don’t think of the 1600s, and there’s a good reason. The name was rarely given before the 20th century, but it has been surging in popularity since the 1950s. Some people believe it’s due in part to the actor Kevin McCarthy, who first became famous with Death of a Salesman (1951). Kevin is definitely a popular name in the Perez family, take a look here and you'll see hilarious texts between The Manely Firm's Karen Perez and her brother Erik calling her "Kevin" over and over... Karen's comical childhood nickname has really stood the test of time!

Happy National Kevin Day to all of the Kevins out there! Kevin below is a fictional person, but even so, he and Erica have a very real problem. Read on for more as to why an experienced attorney is a necessity when considering modifying your current parenting plan.

Kevin and Erica were divorced three ago. Kevin was awarded primary physical custody of their two boys, Spencer and Adam. The parties have coparented relatively well throughout the years and the boys are thriving in both homes. Erica, however, has recently been yearning to spend more time with the boys and want to petition the courts for primary custody. Although both of the boys, Spencer, now 13, and Adam, 12, love living with Kevin, desire to spend more than every other weekend with their mom. Erica has asked the boys to write an affidavit expressing their desires and they oblige. Kevin, content with the way things have been, is frustrated. “Things are going so well. Can she really just up and change that for no reason?”
The Georgia courts have well established a rule that outlines that to authorize a change in custody, it must be shown that there has been a change in conditions substantially affecting the interest and welfare of the children. Essentially, there must be a material change in circumstances. Courts analyze a change in custody on a two-step analysis: 1) a material change in circumstances; 2) best interests of the children.
Erica: But Spencer is old enough to make that decision. Isn’t that considered material? Besides he’ll be 14 in a month.
