SEPTEMBER NEWS & UPDATES
$2 Million Settlement for Minor Sexually Assaulted by Farmhand

Partner Jonathan P. Mincieli secured a $2 million settlement for 13-year-old “Jane Doe” who was sexually assaulted by a 21-year-old farmhand at a farm and recreational facility, where she was enrolled in a program.
"Insurance companies cannot bully victims into taking less than full value by threatening coverage lawsuits. I am proud that Jane had the faith in us to fight through the threats to obtain this excellent result."
$520,000.00 Settlement for Elderly Woman Who Developed Bed Sores in Nursing Home

The trial attorneys of Meyers & Flowers, in combination with their Peru, Illinois sister firm, Meyers, Flowers, Bruno, McPhedran & Herrmann, recently finalized a $520,000.00 nursing home negligence settlement for an 85-year-old woman who developed bed sores because her central Illinois nursing home failed to provide proper care and treatment.

After completing numerous depositions of staff members at the nursing home, James A. McPhedran and Craig D. Brown were able to establish that Abigail did not recover and return to her pre-surgical level of independence because of the substantial pressure sores caused by the neglect of the nursing home and their staff. In the end, Mr. McPhedran and Mr. Brown were able to convince the nursing home to pay $445,000.00 and a physical therapy firm to pay $75,000 for a total settlement of $520,000.00.

Baby Safety Tips
September is Baby Safety Month, championed by the Juvenile Products Manufacturers Association (JPMA). This month aims to help educate parents and caregivers on the safe selection and use of children's products while encouraging those around us to become safety ambassadors. As a family-focused law firm, we are committed to doing everything possible to keep your family safe, especially our youngest family members. To help you review the best practices to keep your little one safe, Meyers & Flowers posted baby safety tips throughout September.

Register Your Baby Products
Taking the fast and simple steps to register the products your toddler uses is the only way to ensure you are personally alerted about product safety hazards or recalls. Registering your products can be done online or by way of mail using the registration card included in every infant durable product packaging.

Car Seat Safety Tips
This month we encourage family members and caregivers to take a good look at their child’s car seat to make sure they have followed these basic rules:
  1. Select the right car seat.
  2. Use your car seat in the correct direction.
  3. Install properly.
  4. Know when to change your seat.

Research Your Infant Formula
Parents of premature babies may turn to formula feeding with brands like Similac and Enfamil to help their baby gain weight. These products are marketed as nutritionally complete human milk alternatives. However, studies have shown the risk of infants developing Necrotizing Enterocolitis (NEC) is substantially heightened when fed cow’s milk-based formulas.

Attorney Gladys Proa Santana was interviewed in the Illinois State Bar Association's Standing Committee on Women and the Law's newsletter, The Catalyst. She describes how she got to where she is today while acknowledging those who helped her along the way and offers her words of wisdom to new attorneys. Gladys gives special acknowledgment to one of the first attorneys she met shortly after becoming a lawyer - Meyers & Flowers Partner Ryan P. Theriault

“He is a talented lawyer who is ambitious, witty, funny, honest, and generous with his time, which is a most valuable commodity in the legal field (and in life!). Having been a first-generation attorney who came from a working immigrant family, Gladys did not have the luxury of family or friends who were lawyers to teach her the ropes. She had Ryan. He taught her practical skills, opened her eyes to opportunities she did not know existed and has allowed her to share in his triumphs and successes. She said that Ryan Theriault has undoubtedly impacted the trajectory of her career and has pushed her to be a better lawyer.”

Chlorpyrifos, a widely used pesticide linked to brain damage in children is finally banned in the U.S. As the EPA makes progress to enact long-overdue reforms, it raises further concerns as to why little action has been taken to restrict the use of paraquat - a herbicide found to cause users to be twice as likely to develop Parkinson’s disease.

INVESTIGATING - FDA Requires Additional Warnings for JAK Inhibitors About Adverse Health Effects
The FDA has issued yet another safety communication to patients and health care providers about their revisions to the Boxed Warning due to conclusions of an increased risk of serious heart-related problems and cancer with the use of Janus kinase (JAK) inhibitors. The FDA is now requiring new and expanded warnings for three approved rheumatoid arthritis treatments - Xeljanz, Olumiant, and Rinvoq.
If you have suffered due to a JAK inhibitor resulting in serious harm, please contact us today to explore your legal options.
