Civility and Respect

Anyone who knows me will tell you that I love to eat. And while it’s true I love a good meal as much, if not a bit more, than the next person — it’s not just about the food. There is something about sharing a meal and conversation, about the act of breaking bread with others that is often even more satisfying than the food itself.

The picture continues to worsen. The U.S. just broke the 150,000 mark on Covid-19 deaths. The highest in the world. The U.S. recorded roughly 4,500,000 confirmed Covid-19 cases in the last six months since the pandemic hit the U.S. in February.

The Primerus Optimistic Index
Primerus remains at a 4.0 on the optimistic scale. As the graphs indicates and as discussed in the Blindsided article, there remains a great deal of uncertainty on where this is going. The bad news is that U.S. economy suffered its worst period in the second quarter, with the GDP falling a historic 32.9%. The somewhat offsetting good news is that economists surveyed by Dow Jones expected 34.7 % drop, and the Dow seems to be holding, at least as of last Thursday, above 26000.

Jump Start Your Social Media

Digital marketing has becoming increasingly more important over the years, but amidst the pandemic, it is paramount. Social media is a major component of digital marketing that we will focus on today. In my opinion, social media can be summed up in one word: overwhelming.
How to be Visible in Primerus
B y: Katie Bundyra

Being visible in Primerus is easier than ever. As you have seen in past Weekly articles, there are multiple opportunities to speak and publish through your Primerus membership. Below is a brief overview of some of the other ways to be visible within Primerus.
August 4th - Privacy Shield Ruled Invalid by CJEU in Schrems II:  Where do we go from here?

  • The Court of Justice of the European Union, on July 16, invalidated the EU-US Privacy Shield Framework as a mechanism for transferring personal data from the EU to the United States, a decision that greatly impacts over 5,000 entities that relied on Privacy Shield for transfers of personal data from the European Union.
  • The decision potentially impacts over $7 billion in Transatlantic trade.
  • This webinar will analyze the legal and business impacts of the Court’s decision, including the Court’s skeptical discussion of Standard Contractual Clauses as an alternate method of data transfer, and the practical implications and recommended next steps for organizations that are registered with the Privacy Shield Framework or work with business partners or vendors who transfer data under the Framework.
August 6th - An Accountant and a Lawyer Were Laying on a Beach...

There has never been a time in recent history like the present where accountants and lawyers are required to collaborate on behalf of their mutual clients. Who would have predicted that 2020 would bring a global pandemic, an ensuing great depression, trillions of dollars in stimulus money entering the economy and race riots / social unrest? At BDO, we have seen firsthand how our clients are re-thinking their business models by reacting, becoming resilient and realizing the new normal. BDO has helped its clients Re-think today’s business environment including helping our clients with COVID related insurance claim and filing for PPP loans to transitioning to work from home via state of the art digital solutions, cyber protection and enhanced risk assessments. We have been delivering in lock-step with our client’s Counsel. With a focus on insurance, BDO’s forensic accounting practice will highlight three areas that complement our client’s legal teams service offering and are growing in today’s new world environment:
  1. Property / Cyber / Business Interruption Claims - from civil unrest to ransomware attacks, BDO’s Forensic Insurance & Recovery Practice will review the common valuation issues, common areas of dispute and emerging trends.
  2. Fidelity / Employee Dishonesty Claims - the fraud triangle is commonly referred to as Pressure, Opportunity and Rationalization as the three components of fraud. The last 4 months have seen a significant increase in both Pressure and Opportunity as employees have faced job/pay cuts and the workforce has mostly transitioned to work-at-home.
  3. Reps & Warranties Insurance Claims - while deals have slowed, we are seeing a lot of restructuring activity that, we believe, will lead to combinations and mergers. We expect to see COVID being used as a crutch in explaining a lot of performance issues going forward. This heightens the challenges for due diligence teams and our R&W accounting experts will explain how these insurance policies are bring value to the deal.

What Trial Lawyers Need to Know to Make the Transition to Online Trials

Trial courts are reopening, and some civil jury trials have started. Trial judges are experimenting with the use of online technologies and conducting voir dire using online video services and video conferencing witnesses. In Alameda County, California two personal injury asbestos trials are under way. In-person trials may become a thing of the past and trial lawyers will be faced with the challenges of communicating with jurors remotely and dealing with witnesses who may not be physically present in the courtroom. This webinar will present an overview of how some courts are using remote technology in civil trials, the legal challenges being made and what lawyers should know about adapting to these inevitable changes. Richard Gabriel is a nationally known trial consultant who is currently spearheading The Online Courtroom Project that includes a prestigious group of trial consultants, retired judges and trial attorneys to study the use of remote technologies in trial, litigation and ADR. The Online Courtroom Project has conducted and reported on the results of a complete online demonstration trial. John Brydon is an attorney with over 40 years of trial experience and is monitoring two California civil jury trials currently using remote technologies to try preference asbestos personal injury cases. Remote trials are a reality. Trial lawyers and their firms need to adapt to these changes or else face the harsh reality of being left behind.
