MMA Secures PPE Tax Exemption for Industry
The Department of Treasury this week issued Revenue Administrative Bulletin 2020-9 in response to the MMA Tax Policy Committee’s request, exempting COVID-19-related personal protective equipment (PPE) from sales and use taxes by including it in the definition of industrial processing.
This is an important win for manufacturers as companies have spent significant sums on the newly-required PPE. This action represents a tax cut specifically for manufacturers and has immediate effect. In addition, the agency responded to our specific request that it be retroactive, rendering all eligible PPE expenditures since the beginning of the crisis exempt. The response to comments document even suggests companies can submit refund requests for those sales and use taxes already paid on the COVID-19-related PPE.
MMA wishes to thank the Department of Treasury for responding quickly to this request.
