Client Alert
September 10, 2021

As a reminder, New York City will be enforcing the requirements of the Key to NYC program beginning Monday, September 13, 2021.

Under the Key to NYC program, indoor food services businesses, indoor gyms and fitness settings, and indoor entertainment and recreational settings must ensure that all employees, contractors and customers provide proof that they have received at least one dose of the vaccine and matching identification in order to participate in these indoor activities, unless the individual is only entering the establishment for a quick and limited purpose. For more information on what businesses are covered and the types of acceptable proof and identification, please refer to our previous client alert.

Covered businesses must develop a written implementation plan describing how the business will check the vaccination status of individuals upon entry to the establishment. The City has published a model implementation plan available on its website for businesses use.

All covered businesses must post the Vaccination Required Poster for Businesses, available here, in a place that is clearly visible to people before they enter the establishment.

´╗┐Covered businesses are encouraged to consult counsel and/or review the following resources provided by the City:
