Governor Cuomo has just announced that effective May 7, 2021, indoor dining capacity for NYC restaurants will increase to 75%, catching NYC up to the rest of the state.
This increase in capacity should also be reflected in the maximum capacity for indoor catered events in NYC – as is already the case in the rest of the state, indoor event capacity in NYC will now be the lesser of 150 people or 75% capacity for a particular area set by the certificate of occupancy, up from 50%.
Finally, as a reminder, effective Monday, May 3, 2021, patrons dining on premises will no longer be required to order food when ordering alcoholic beverages. We have confirmed with the SLA that this change only affects on-premises dining, and that food purchase is still required in order to purchase alcohol to go or for delivery.
