New York Increases Compensation for Employees on Jury Duty

The 2025 New York State budget amended the Judiciary Law to increase the daily compensation rate for jury duty from $40 to $72 per day. Accordingly, as of June 8, employers with 11 or more employees must pay employees who are called to jury duty $72 per day for the first three days of jury service.


However, if an employee normally earns less than $72 per day, the employer must pay the employee’s regular wages, and the state will reimburse the employee for the difference between the employee’s daily wage and the $72 jury service rate. Conversely, if an employee normally earns more than $72 per day, the employer must pay the employee at least $72 per day.


Employers should immediately review and update their jury duty policies and payroll practices to ensure compliance with the new compensation requirements.
