Restaurants with permitted roadway cafe dining setups must remove the structures by November 30, 2024.

Roadway cafe dining setups permitted under the Dining Out NYC program can only operate from April 1 through November 29 each year, so the time for removal is fast approaching. However, permitted sidewalk cafes are allowed to operate year-round and need not be removed.

For restaurants that did not previously apply to Dining Out NYC by August 3, 2024, and kept their un-approved outdoor dining structures running, these structures must be disposed of immediately. Restaurants should consult with the NYC Department of Sanitation to properly dispose of their dining structures.
