Use of Form 801
We have seen a significant increase in the non-compliant use of the Form 801 Offer Summary Document.
Buyers Agent
The top half of the Form 801 should be completed and sent with your offer to the listing agent. You must include all of the relevant information on the form including: property address, brokerage name, sales representative’s name, buyer’s name, signature, submission date/time and irrevocable date.
Listing Agent
When receiving an Form 801 Offer Summary Document, you must complete all the relevant information on the bottom half of the form: sellers name, contact info, listing brokerage, sale representative's name as well as the time and date the offer was received and how and when it was presented to the seller, and the action that was taken.
We suggest if you are listing a property to put into your Brokerage remarks section:
" All offers must be accompanied by a completed signed Form 801".
If you do not receive a 801 from the Buyers agent, please remember we will require a copy of the offer and its status when submitting your deals.
