Supreme Court to determine if Title VII prohibits discrimination based on gender identity
The EEOC and OSHA Still Interprets Title VII to include Protections for Transgender
  • This fall the Supreme Court will hear the case of EEOC v. R.G. & G.R. Harris Funeral Homes, in which it will decide whether Title VII prohibits discrimination on the basis of gender identity.
  • The case is on appeal from a 2018 decision of the Sixth Circuit Court of Appeals. EEOC v. R.G. & G.R. Harris Funeral Homes.
  • In Harris Funeral Homes, a former employee of a funeral home was terminated after she transitioned from male to female.
  • The Sixth Circuit ruled that, while transgender status is not specifically protected under Title VII, alleged discrimination based on transgender status can be pursued under Title VII as a form of sex or gender-based stereotyping.
  • The Supreme Court has accepted the case for appeal and is expected to resolve a split among federal appeals courts on the issue.

However, the EEOC and OSHA continues to interpret Title VII to include protections for LGBT community. Therefore, the workplace should still follow the EEOC until further notice! The Supreme Court will rule by the end of 2019.
EEOC Must Continue Collecting Pay Data Until January 31, 2020 (US)
On October 29, 2019, the U.S. District Court for the District of Columbia ordered that the EEOC must continue to take all steps necessary to complete EEO-1 Component 2 data collection for calendar years 2017 and 2018. As we recently discussed  here , the EEOC filed a motion on October 8, 2019 asking the court to issue an order deeming the Component 2 data collection “complete.” The court denied the EEOC’s request and ordered the agency to keep collecting pay data until January 31, 2020. 
Department of Labor's New Audit Focus!

Working off the clock labor is that which is unpaid or not contributing to  overtime pay , and is usually illegal.
The United States  Fair Labor Standards Act  (FLSA), is legislation designed to protect workers in most states. The FLSA articulates that employees be paid overtime for more than 40 hours a week. Due to integration of the FLSA in most state labor law, U.S. employee rights are protected insofar that they must be paid the minimum wage, as well as overtime, and the same compensatory or insurance benefits as other workers in the same role.
