Presentation for initial discussion regarding the Draft ResourceX priority-based budgeting return on investment report to provide guidance for upcoming September public budget hearings. strategies proposed by the consultant included implementing new fees, regionalizing some services with neighboring counties and privatizing some services. No specifics were shared during this discussion. CBIA will be monitoring budgetary recommendations and following the hearings to determine if we need to participate should the budgetary process affect our members.

Voted (unanimous): Recommendation the Collier County Consolidated Impact Fee Ordinance, providing for the incorporation reference to the “Water and Wastewater Impact Fee Study amending the water and wastewater system impact fee rate schedule, providing for a delayed effective date of December 1, 2024, for Phase One, December 1, 2025, for Phase Two, and December 1, 2026.


Presentation regarding the FY 2025 budget to provide further guidance prior to the September public budget hearings. McDaniel reiterated a suggestion for a potential merit pay program. No specific recommendations relative to affecting our members. CBIA will continue to monitor and participate in budget hearings if necessary.

Voted (5-2 in favor with Mayor Heitmann and council member, Linda Penniman opposing): A resolution determining fence and wall waiver petition to allow a wall (11') exceeding the maximum allowable height for the Port Royal Club.


Voted (unanimous): On the second reading of an ordinance amending the comprehensive plan to add the vision document.

State Legislative Update

FHBA Advocacy Efforts


Live Local Act Refinements: FHBA will propose edits to help builders and bankers move forward with more confidence on projects with modifications to key definitions and clarifying requirements to ensure the continued confirmation of tax exemption benefits included in this important legislation.


Impact Fees and Extraordinary Circumstances: Local governments, school districts, and special districts are only allowed to increase impact fees by an additional 25% in two equal increments after an increase is implemented unless there is an “extraordinary circumstance.” When the use of extraordinary circumstances was introduced, the legislative intent was that it would be used for large growth developments, not arbitrary reasons unrelated to unique population growth. FHBA will request clarification for defining "extraordinary circumstances."

Lawsuit re Corps of Engineers 404 Assumption of plan review: because of a negative legal decision, the Florida Dept. of Environmental Protection (FDEP) recently lost the delegation of authority to review builders’ plans on behalf of the Corps of Engineers – for now as a result of filed amicus brief. Rep. Toby Overdorf, (R-85) State House Member from Stuart, joined FHBA’s 404 Panel at the summer conference discussing his efforts on this important and how FHBA and local associations can assist.  

*CBIA leadership will be meeting with Senator Passidomo in early October to discuss our priorities for the upcoming legislative session and how we can work collaboratively with our legislators.
