I wanted to provide a brief update on the Department of Business and Professional Regulation’s Rule 61A-8 related to convenience store safety and security.
The final version of the rule, which is scheduled to take effect May 1, can be found here.
FPMA has been actively engaged with DBPR on this rulemaking since October, working closely with the Department to ensure the rule is in a more workable place for our members.
Importantly, DBPR has indicated they are willing to work with convenience store operators to achieve compliance, and at this time, we do not anticipate an overly aggressive enforcement posture.
We encourage members to review the rule and begin preparing for implementation, but note that it largely ratifies the requirements under Section 812.173, Florida Statutes, that you have been operating under since 2021.
