Riddle , our firm’s excellent attorneys, Edward Daniels , Lee Sagatelyan , Steven Berki , Clare Capaccioli Velasquez , Sumble Manzoor , Andrea Nguyen , Susan Spiker , and Dallas Dean , and our stellar staff. I know they will carry on my service to San Mateo County and its residents."
Expansion of Fair Employment and Housing Act
SB 1300 is a recently enacted statute which significantly expands employer liability under the California Fair Employment and Housing Act (FEHA). SB 1300’s changes to FEHA will make it much easier for employees to file, litigate, and prevail on harassment and discrimination claims against California employers because it lowers the burden of proof that the employee must meet.  It also expands FEHA protection to any harassment by contractors, whereas previously employees were only protected from sexual harassment by contractors. As a result, it is vital that employers are vigilant in preventing harassment in the workplace and take immediate corrective action when claims of harassment arise. Employers should reach out to our employment counseling team to make sure that their anti-harassment and discrimination policies are effective. Employers should also seek counsel before asking employees to enter into non-disparagement agreements, confidentiality agreements, and agreements that seek to waive FEHA claims in exchange for a raise or a bonus or as a condition of employment or continued employment, because SB 1300 impacts an employers’ right to require such agreements from an employee.
Employers May Still Ask Candidates About Salary Expectations, Just Not Salary History
AB 2282 specifies that the current prohibition on asking a job applicant about prior salary does not forbid an employer from asking the applicant about his or her salary expectations for the position being applied for. It makes clear that prior salary cannot be used to justify a disparity in pay based on sex, race or ethnicity. AB 2282 excludes from the above prohibition a compensation decision based on a current employee’s existing salary, so long as any wage differential resulting from that compensation decision is justified by one or more specified factors under Labor Code §1197.5, including a seniority system or a merit system.

Spring Cleaning Your Estate Planning Documents
The flowers are blooming and we have spring cleaning on our minds. While you are going through you closets, take a look at your estate planning binder. Is it in an accessible place? Have you told family members where they can find it when the time comes? Also, take the opportunity to make sure your documents are up to date. If there are any updates that need to be made due to changes in your wishes, family dynamics, or the law, our estate planning team would be happy to help you out.

Please contact Stevan Luzaich to set up an appointment.
