Tax News
On November 5, 2021, Congress passed the Infrastructure Investment and Jobs Act (H.R. 3684). This bill is expected to be signed by the President and enacted into law. Among several tax provisions in the bill, two of the most significant are information reporting requirements for digital assets such as cryptocurrencies and NFTs and an early end to the popular employee retention credit (ERC).

Digital Asset Reporting Requirements
Effective for filings after December 31, 2023, Sec. 80603 of the bill expands both the definition of “broker” and reporting requirements for brokers related to the transfer of digital assets with value. This is expected to be a revenue raiser as it will bring more digital asset transactions to light.

Early End to the ERC
Despite communities going into government ordered shutdown again, Sec. 80604 of the bill ends the ERC on September 30, 2021, for all but recovery startup businesses. What this will mean for businesses that have already reduced payroll taxes and filed Forms 7200 for the fourth quarter of 2021 is unclear. 
Remembrance of David Riposo
Our hearts were broken when we learned that David Riposo, the beloved husband of FTL Board Chair Magnolia Movido, and former CFO, passed away after a two-year battle with brain cancer on the morning of November 1, 2021. David was know for his quick intelligence, generous nature, infectious smile, and devotion to family, including five children Carmela, Amanda, Trajan, Tiara, and Toni.
