Public Hearing
Bylaw No. 302 (6935 Dickinson Road)

The Mayor declared open the electronic public hearing, convened in order to receive and consider input regarding "District of Lantzville Zoning Bylaw No. 180, 2020, Amendment Bylaw (6935 Dickinson Road) No. 302, 2022", a bylaw to rezone a portion of property at 6935 Dickinson Road from Future Study Area Zone (F-SA) to Residential 5 Zone to facilitate an 8-lot subdivision.

At the public hearing, Council received four (4) pieces of correspondence. 
Members of the public were able to provide verbal input in-person at the Council Chambers or electronically via ZOOM. There were five people in total who spoke at the hearing; two (2) of whom spoke twice. After the public hearing closed, Council must not receive any further submissions from the public. Questions can be directed to staff at district@lantzville.ca.

Third reading of proposed Bylaw No. 302 was considered later in the agenda under Legislative Matters.
Bylaws
Bylaw No. 302 (6935 Dickinson Road)

Council gave third reading to “District of Lantzville Zoning Bylaw No. 180, 2020, Amendment Bylaw (6935 Dickinson Road) No. 302, 2022”.

Proposed Bylaw No. 302 will not be considered for adoption until the registration of a covenant for the provision of community amenity contribution and a permanent speed reader sign in the vicinity of Dickinson Road to the satisfaction of the Director of Public Works, or funds have been provided to the District to purchase and install a speed reader sign in the vicinity of Dickinson Road.
Water System Amendment Bylaw No. 308

Council adopted the “District of Lantzville Water System Bylaw No. 140, 2018, Amendment (User Fees) Bylaw No. 308, 2022” to provide for water user fees to commence when the water meter is installed, rather than on the date of occupancy.

When a single family dwelling is connected to the District’s water system, contractors and trades use water during construction. This amending bylaw will provide for earlier billing that will eliminate a costly first time utility bill.
Election and Assent Voting Amendment Bylaw No. 310

Council adopted the “District of Lantzville Election and Assent Voting Bylaw No. 160, 2018, Amendment Bylaw No. 310, 2022” to allow all eligible voters to vote by mail (subject to applying in advance).

The Local Government Act used to restrict eligibility for an elector to vote by mail requiring a declaration that the elector had a physical disability, illness or injury that would affect their ability to vote at a voting location, or they expected to be absent on general voting day and all advance voting opportunities. The Province amended the Act in 2021 to allow all eligible electors the option to vote by mail, if provided in the local government's election bylaw. Application forms will be available by September for those electors who wish to register to vote by mail.
Official Community Plan Amendment Bylaw No. 283 (Village South Special Area Plan)

The proposed Village South Special Area Plan consists of three (3) parcels of land at 7220 Ware Road, 6855 Wiles Road and 7133 Lantzville Road, supporting a variety of commercial and residential land uses to be developed in stages over a number of decades.

After the April 13, 2022 public hearing to consider the proposed amending bylaws, at the May 4, 2022 regular Council meeting Council referred consideration of third reading for each bylaw back to staff to work with the developer to improve their application. Amended bylaws were included in the June 8th agenda for Council's consideration.

Council withdrew the May 4, 2022 motion on the floor for third reading of Bylaw No. 283 and rescinded second reading given September 22, 2021.

Council referred the balance of the June 8, 2022 Council meeting agenda to a special meeting to be held between June 13 to June 17, 2022. The special meeting was held June 15, 2022.

At the June 15th meeting, Council gave "Official Community Plan Bylaw No. 150, 2019, Amendment (Village South Special Area Plan) Bylaw No. 283, 2021" second reading as amended (reducing the maximum number of units to 632) and as further amended in Appendix 2, in 3.1 Zoning, Parks, Greenways & Community Lands, by striking "and trails is 21% of the (net) site area" and replacing with "4.85 hectares". Council also scheduled an electronic public hearing for Bylaw No. 283 to be held at a special Council meeting on Wednesday, July 13, 2022 at 6:00 pm. Limited seating in the Council Chamber will also be available.
Zoning Amendment Bylaw No. 284 (Village South Special Area Plan Zone)

Council withdrew the May 4, 2022 motion on the floor for third reading of Bylaw No. 283 and rescinded the second reading given February 23, 2022.

Council gave “District of Lantzville Zoning Bylaw No. 180, 2020, Amendment (Village South Special Area Plan Zone) Bylaw No. 284, 2021” second reading as amended (see agenda); AND as amended further in Schedule 1:
  • section 4 table by adding a third column titled “Total Units”, with ‘232’ in Area A row, ‘300’ in row combined for the two Area B rows, with ‘100’ in Area C row, and ‘632’ in a new row ‘All Areas Combined’
  • section 3 by adding after “mixed-use building format” the words “(with the exception of 50 units of seniors supportive housing)
  • subsection 4b. striking “Notwithstanding subsection 4 and 4a.”.

Council also scheduled Bylaw No. 284 to be included at the electronic public hearing to be held at the special Council meeting on Wednesday, July 13, 2022 at 6:00 pm. Limited seating in the Council Chamber will also be available.
Pride Flag
Council passed a motion to display a Pride Flag for the remainder of June 2022, and for staff to provide a report regarding the District of Lantzville Flag Policy for Council consideration.
The balance of the agenda was referred to the next Council meeting.
The Next Scheduled Council meetings are:

  • Wednesday, June 22nd - 6:00 pm Regular
  • Wednesday, July 6th - 6:00 pm Regular
  • Wednesday, July 13th - 6:00 pm Electronic Special (including Public Hearing)
  • Wednesday, July 20th - 6:00 pm Regular

Council members may attend in person, or electronically (except for the Mayor) for a hybrid meeting, or via Zoom Webinar for an Electronic Meeting (per the Community Charter and the Council Procedure Bylaw). Public Hearings are held electronically to provide greater access, transparency and convenience. Zoom also offers the option to dial in by phone. For in person, hybrid and Electronic Meetings, the Council Chamber is also open for the public to attend. Due to limited seating, the public is encouraged to view the open portion of the meeting via the livestream, and to provide verbal public input on agenda items by registering in advance using the Zoom Webinar link provided for each Council meeting event at lantzville.ca, submit written comments by Noon the day of the meeting, or attend in person to provide public input. Prior to attending at Municipal Hall, please self-assess to ensure you are healthy and do not attend if you are ill. Members of the public must remain seated unless invited to address Council. Meetings recorded by the District of Lantzville may be viewed at lantzville.ca. The public is prohibited from recording Council meetings unless authorized by Council.
