We all find ourselves in the midst of a global pandemic, the likes of which the world has not seen in some time. The loss of human life has been staggering, and trade and commerce have been affected in ways we could not imagine.

The Primerus Optimistic Index
Primerus is moving up from a 3.5 to a 4.0 on the optimistic scale. Two factors are encouraging:
1. The stock market is holding steady after its long climb from the crash in March.
2. The U.S. administration appears to be finally coming around in support of the mask wearing and social distancing guidelines as our only weapon to defeat this virus at this time.

August 4th - Privacy Shield Ruled Invalid by CJEU in Schrems II:  Where do we go from here?

  • The Court of Justice of the European Union, on July 16, invalidated the EU-US Privacy Shield Framework as a mechanism for transferring personal data from the EU to the United States, a decision that greatly impacts over 5,000 entities that relied on Privacy Shield for transfers of personal data from the European Union.
  • The decision potentially impacts over $7 billion in Transatlantic trade.
  • This webinar will analyze the legal and business impacts of the Court’s decision, including the Court’s skeptical discussion of Standard Contractual Clauses as an alternate method of data transfer, and the practical implications and recommended next steps for organizations that are registered with the Privacy Shield Framework or work with business partners or vendors who transfer data under the Framework.

What Trial Lawyers Need to Know to Make the Transition to Online Trials

Trial courts are reopening, and some civil jury trials have started. Trial judges are experimenting with the use of online technologies and conducting voir dire using online video services and video conferencing witnesses. In Alameda County, California two personal injury asbestos trials are under way. In-person trials may become a thing of the past and trial lawyers will be faced with the challenges of communicating with jurors remotely and dealing with witnesses who may not be physically present in the courtroom. This webinar will present an overview of how some courts are using remote technology in civil trials, the legal challenges being made and what lawyers should know about adapting to these inevitable changes. Richard Gabriel is a nationally known trial consultant who is currently spearheading The Online Courtroom Project that includes a prestigious group of trial consultants, retired judges and trial attorneys to study the use of remote technologies in trial, litigation and ADR. The Online Courtroom Project has conducted and reported on the results of a complete online demonstration trial. John Brydon is an attorney with over 40 years of trial experience and is monitoring two California civil jury trials currently using remote technologies to try preference asbestos personal injury cases. Remote trials are a reality. Trial lawyers and their firms need to adapt to these changes or else face the harsh reality of being left behind.
