DHS rescinds F-1 plan to require in-person classes during pandemic
On July 14, 2020, in the U.S. District Court for the District of Massachusetts in a hearing involving litigation filed by Harvard and the Massachusetts Institute of Technology (MIT) challenging DHS's July 6, 2020, international student guidance, DHS has agreed to fully rescind the July 6, 2020 ICE guidance and rescind all implementing guidance.
The status quo will remain in force, which is to say that F-1 students will be permitted take all online courses if the universities they attend are offering only online courses due to the pandemic. Their universities will not be required to provide all F-1 students new I-20s by the end of August as had been previously anticipated.
