DOT Guidance on Compliance with Drug and Alcohol Testing Regulations
At AMS, we have only just received the attached DOT guidance. Please review it thoroughly. While it does appear to emphasize caution and to permit limited delays within the existing regulations, it does not provide for an enduring moratorium on testing.
Likewise, without a “negative” pre-employment drug test result, an employer still may not permit a prospective or current employee to perform any DOT safety-sensitive functions.
Given this DOT guidance, maritime employers should endeavor to maintain continuity in their mandated testing programs and anticipate continued enforcement of the existing regulations.
