Congressman David Joyce (OH-14) Urges President Biden to Create Special Advisor on Sexual Violence at HHS

Staffing this role with an experienced advocate for sexual assault survivors reporting directly to the HHS Secretary would be an unprecedented and important step for coordinating and strengthening how the federal government responds to sexual violence and supports survivors.

Sexual violence is a public health crisis. Conditions including depression, anxiety, post-traumatic stress disorder, joint conditions, cervical cancer, sexually transmitted diseases, and heart disease are all more likely to occur when a person has experienced sexual violence. Additionally, sexual violence can contribute to substance use and other health crises that HHS has worked to address under its mission.

A special advisor focused on these concerns would provide a crucial starting point for HHS to develop new and innovative strategies to combat sexual violence from a health perspective.

Declare racism a public health crisis

Committees: House State and Local Government Committee, Senate Health Committee

"OAESV has re-energized its strategic plan, opened up and reviewed our employee handbook, analyzed our trainings and programs, and focused on our mission and values with an equity lens. We have actively urged our member rape crisis programs to do the same, and are providing vigorous support to that end. We know we are not the only sector that needs to actively change to dismantle racism. Our state government must heed the strategies outlined in this proposed resolution. To dismantle anti-Black racism and oppression in all its forms, change must take place from government offices, to state agencies, to non-profit programs, education institutions and the for-profit sector."

Erin's Law - HB 105
Regards age-appropriate child sexual abuse instruction
Sponsors: Representative Lipps, Representative Kelly
Committee: House Primary and Secondary Education

Current law does not mandate education addressing the pervasive problems of sexual abuse and sexual violence. Erin's Law would require sexual abuse prevention education in grades K-6, add sexual violence prevention education in grades 7-12, and require additional training for school personnel. Ohio is a regional outlier, as Indiana, Michigan, West Virginia, Pennsylvania, and New York have all passed Erin's Law. Erin's Law curriculum first appeared in public schools in 2009, and Ohio's legislation meets our individual state's needs for district expertise in crafting compliant lessons.

New Research on Child Sexual Abuse
Emerging research shows that parents are major producers of child sexual abuse (CSA) material. Almost 70 million reports of CSA material were made to U.S. authorities in 2019. That figure rose even further in 2020, as the COVID-19 pandemic drove children to stay at home with abusive adults. Children abused by a parent are the least likely group to disclose to anyone, and the shame and fear caused by trauma makes it extremely difficult to speak out.

We must act now to establish protective policies for when Ohio's children return to school and need additional support and education from trusted adults.
HB 199
Remove the cap on damages for noneconomic loss when a victim of rape or assault brings a tort action
Sponsors: Representative Boggs, Representative Russo
Committee: House Civil Justice Committee

This bill would remove limitations on the amount of compensatory damages for noneconomic loss in tort actions brought by a victim of rape, felonious assault, aggravated assault, assault, or negligent assault.
