After much debate focused on the impact of HB 7's mandate to refer abortions and refer or provide transgender procedures in schools, several radical House Dems took to defending the need to include underage kids, that "trusted adults" other than parents are involved in "a child's health care decision." They rejected an amendment to exclude children from HB 7's predatory mandate.
"It's clear radical left New Mexico Democrats who voted for HB 7 are placing their politics and well funded abortion lobbyists above children and parent's rights," said Elisa Martinez executive director of New Mexico Alliance for Life. HB 7 will now move to the NM Senate for committee hearings: most likely in the Senate Health & Public Affairs and Senate Judiciary committees before the Senate Floor. Action items below!

WHAT DANGEROUS SB 13 DOES:
SB 13 establishes a class of "protected health care" namely, "reproductive and gender-affirming" procedures exempt from civil or criminal liability by the licensing boards of their specialties and by other states where activities protected in New Mexico are not protected.
BE PREPARED TO TESTIFY AGAINST SB 13, VIA ZOOM HERE. PLEASE USE THE FOLLOWING NMAFL ANALYSIS:
SB 13: Eradicates parents rights and allows for trafficking of an underage child by someone other than a parent to undergo an abortion and any host of transgender procedures.
SB 13: Codifies Governor MLG’s radical Executive Order 2022-107.
SB 13: Drives a wedge between parents and their child. If a child is brought from out-of-state to receive an abortion or transgender procedure, the child’s parent would be barred from seeking any information about what was done their son or daughter.
SB 13: Creates new rights and exemptions from liability for violating interstate laws for those who perform abortions and transgender procedures
Follow the Money – SB 13 and SB 7 are profit drive bills aiming to set New Mexico up as a destination and revenue generating enterprise for abortions and transgender procedures, while circumventing parental involvement laws.
SB 13 is a predatory bill that – places politics before children and their parents.

WHAT HB 7 DOES:

HB 7 will force all New Mexico public institutions that receive public funding and employees, such as elementary school teachers to refer or provide any request for abortion and "gender-affirming" health care - Section 3B.

HB 7 will penalize the public employer or body that "directly OR indirectly" "deny, restrict or interfere with a person's ability to access or provide reproductive health care or gender-affirming health care" -- despite the best interest of the child or individual: Section 3B, and amended section 5D.

HB 7 seeks to ban any effort by all lawmaking bodies at the local and state level from legislating against it, “a public body or agent of a public body shall not impose or continue in effect any law, ordinance, policy or regulation that violates or conflicts with the provisions set forth in this bill:" Section 3D.
- HB 7 violates the constitutional rights of all New Mexicans for due process, freedom of speech, freedom of religion and equal protection. It penalizes New Mexico's public bodies under threat of prosecution and civil penalties up to $5K for an agent exercising any of these constitutional rights. Section 5C.
