California Family Rights Act (CFRA) - As reported in this publication in September, significant amendments to the California Family Rights Act (CFRA) take effect on January 1, 2021. Most notably, CFRA will apply to employers with five or more employees. CFRA requires covered employers to provide up to 12 weeks of unpaid, job-protected leave to eligible employees for certain reasons, such as baby bonding. Employers are required to post a notice about employees’ CFRA rights. A compliant notice will be provided by the Department of Fair Employment and Housing (DFEH). It is recommended that the DFEH website is checked periodically.

Crime Victim Leave - Employers of all sizes are required to provide job-protected leave to victims of stalking, domestic violence, and sexual assault. Yesterday, December 14, 2020 the Office of the Federal Register (OFR) published a new rule aiming to boost patient data exchange and streamline prior authorization to alleviate clinician burden, thereby allowing providers to improve patient care and spend more time with their patients. This proposed rule would place new requirements on state Medicaid and CHIP fee-for-service (FFS) programs, Medicaid managed care plans, CHIP managed care entities, and CMS-9123-P 2 Qualified Health Plan (QHP) issuers on the Federally-facilitated Exchanges (FFEs) to improve the electronic exchange of health care data, and streamline processes related to prior authorization, while continuing CMS’ drive toward interoperability, and reducing burden in the health care market. Prior authorization is a key utilization management strategy many healthcare payers use to ensure patients access the most clinically and cost-effective medication available to them. When a drug has prior authorization requirements, the provider must submit certain documents to a healthcare payer to receive permission before prescribing the drug. Completing prior authorization can be demanding for providers and lead to delays in patient care access, with 46 percent of clinicians submitting authorization requests by fax and 60 percent made over the telephone. However, electronic prior authorization is becoming more prevalent in the medical field. This proposed rule intends to build upon the CMS interoperability rule by increasing interoperability and patient access to data. Effective patient data exchange and improved interoperability can also help minimize the spread of the coronavirus. CMS said the proposed rule would force Medicaid, CHIP, and QHP programs to develop application programming interfaces (APIs) to back patient data exchange and prior authorization. If passed, this rule would require payers to integrate an FHIR-based API to streamline patient data exchange. Patients would have full access to their medical histories and bring this data from one payer to another. Payers, providers, and patients would gain more access to information, including past and pending prior authorization decisions, which would reduce administrative burden, cut costs for providers, and boost patient care.
To be assured consideration, comments must be received electronically, express mail or regular mail, no later than 2pmPST, January 4, 2021.

Though directed to payers, life science companies, patient groups, and others to develop formularies, this cloud-based platform, will allow for even physicians and medical groups the ability of negotiate drug prices, and explore new ways to apply evidence in a drive toward a health system that can achieve fair prices and fair access for all. It would behoove practice contract staff to listen in on December 17, 2020, from 7:00am to 8:00am PST, to a webinar with representatives from both the payer and pharmaceutical industries to demo the tool and discuss how they plan to use it. Panelists include Merck's Senior Vice President and Head of the Center for Observational and Real World Evidence (CORE); Prime Therapeutics' Assistant Vice President, Health Outcomes; and Prime Therapeutics' Principal Health Outcomes Researcher.
