AB Reminder: Directive 040 pressure requirements

Directive 040 Section 2.2.3 requires that annual pressure and testing surveys be completed by December 31, 2022 and submitted by March 31, 2023. Failure to obtain and submit the required pressures and, in some instances, fluid analysis, will result in a $1000 administrative penalty (fine) plus you will still have to obtain and submit the test data to fulfil the 2022 requirement. AB: Rental Waivers for P&NG Agreements with Shut in Wells
|
This Information Letter (IL) replaces IL 2017-35. It relates to Petroleum and Natural Gas (PNG) Agreements acquired prior to December 11, 1996, that have well(s) shut-in by the Alberta Energy Regulator pursuant to the Chard-Leismer Decision (Decision Report 2003-023) and Order 05-001.
As outlined in IL 2017-35, Alberta Energy extended rental waivers for an additional five-year period until December 31, 2022. As such, designated representatives of affected agreements will have to apply to continue to receive a rental waiver after December 31, 2022. In addition to rental waivers, affected agreements with expiry dates on or after September 1, 2003, also were granted term extensions.
Applications to continue to receive a rental waiver must be submitted by email (not through ETS) to Energy.Rentals@gov.ab.ca no later than February 28, 2023.
Please note, rental waivers and term extensions can no longer be transferred with an agreement but will require application by the new licensee. Contact us if you require assistance requesting a waiver and/or term extension.

MB: Manitoba Drilling and Incentive Program
|
The Manitoba Drilling Incentive Program (MDIP) has been extended without alteration for the period January 1, 2023 to December 31, 2024.
|
On January 1, 2023, The Financial Security and Site Closure Regulations (FSSCR) and The Oil and Gas Conservation Amendment Regulations, 2021 (OGCR) came into force. The FSSCR and the OGCR amendments support the administration of new and enhanced oil and gas liability management (LM) programs operated by the Ministry of Energy and Resources (ER).
Please ensure that your organization is aware of and is prepared to follow the requirements outlined in these regulations. Of note, the one-time orphan fund fee for first-time license holders has been removed from the OGCR and is no longer required. Full details on the FSSCR and the amended OGCR can be found in Bulletin BT2021-010 and BT2022-009. These regulations are available on the Saskatchewan Publications Centre website.

SK: Directive PNG001 Consequential Amendment
|
This amendment will align Directive PNG001 with changes to the OGCR in force on January 1, 2023, The changes, among other things, repeals section 16 from the OGCR, which requires first-time licence applicants to pay a one-time, $10,000 “orphan fund fee”. See Section 2 (bullet #6) of Directive PNG001 (“Applicant Responsibilities”).

On December 22, 2022, Directive PNG048: Hydraulic Fracturing Requirements came into effect. The directive clarifies ER’s expectations for management of hydraulic fracturing operations and features requirements.
Please note that Directive PNG013: Well Data Submission Requirements is presently being amended to support the directive regarding fracking data reporting requirements. These amendments are expected to take effect early in 2023 along with other changes to Directive PNG013 currently being consulted on. In the meantime, licensees are to use fracking data reporting functionality now available within ER’s Integrated Resource Information System (IRIS) to ensure more consistent and easily manageable data for ER.
Please also note that licensees that complete a fracking operation on or before January 31, 2023 are allowed 60 days from the date the operation was completed to report it in IRIS without penalty. As well, ER will not assess licensees’ compliance with Directive PNG048 until January 31, 2023.

SK: Directive PNG013: Well Data Submission Requirements
|
The ER is seeking written comments on changes to Directive PNG013: Well Data Submission Requirements. Directive PNG013, in force 2016, outlines requirements for the submission of data for drilling, completion, workover and abandonment of wells licensed under The Oil and Gas Conservation Act.
ER is holding consultations on the amended Directive PNG013 from December 9, 2022 to January 27, 2023. A final draft of the amended Directive PNG013 is expected to come into effect in the winter of 2023.

BC: Update to Suspension of Water Diversions in Liard River Watershed (DIR 2022-07)
|
The BCOGC on December 12, 2022 updated the directive for the Liard River Watershed. BCOGC are requiring the oil and gas industry to continue to suspend water diversions under Section 10 of the Water Sustainability Act, in the certain areas due to drought conditions. This includes rivers, streams and lakes in the following basins within the Peace River, Liard River and Fraser River watersheds.
