WHAT'S NEW?  


CCMI has written about this before, but it bears repeating. If your contracting company does any work on federally funded projects and you want to take fringe benefit credit for health and welfare premiums where the company self-funds part of the benefit or you want to take credit for Holiday or Vacation pay which you keep “on your books”, you MUST obtain approval from the US DOL. CCMI can help you with that process which will include a letter to the DOL detailing your written policy on these items, how no forfeitures or caps on benefits are imposed and how you calculate these benefits. The US DOL also wants to see a copy of your sick pay policy for direct Davis Bacon projects. See 29 CFR part 5.28 or let us help you with this process.

QUESTION:

If I have my own in-house training or apprenticeship program can I take fringe benefit training for the related costs of running the program?

ANSWER: 

The answer to this question is multifaceted. This response is going to explain the federal rules. First, you would be allowed a reasonable cost of instruction, such as cost of instructors, the cost of materials and books and a reasonable amount for the classroom rental. Then divide that across the participants  then divide by 2080 hours to reach a training amount per hour. Please note that this training amount has to go through the same approval process as set forth in the first article above. Typically that cost ranges up to $2 per hour or thereabouts.

 

Please note that State rules can be different. Some states (California) will not let individual companies claim extra training costs even if you have a US DOL approved training program
