Political & Legislative Updates
2018 General Election

The 2018 General Election caused some major shifts in both the PA state legislature and the US Congress. While control of the PA House and Senate remains in the hands of the Republicans, several SEPA seats were flipped. Additionally, Governor Wolf was also elected to a second term. On the federal side, Democrats took control of the House while the Senate remains narrowly controlled by Republicans. New Jersey Revised "Bona Fide Representatives" Rule

On October 4, 2018, New Jersey Governor Murphy signed into law an amendment to the definition of a "bona fide representative" for heating, ventilating, air conditioning and refrigeration ("HVACR") contractors. State Construction Directory
Input Needed

After the major change to the Mechanics’ Lien Law in 2016, owners of projects with a contract sum of $1.5 million or more have the option to register the project on a state web-based directory. It has been nearly 2 years since this directory has been implemented and the state is looking for ways to improve it for contractors. If you have used this online directory on any of your jobs please provide feedback, positive or negative, to Catie Scott at  cscott@mcaepa.org
Multiemployer Pension Reform Update

On November 16, 2018, the Select Congressional Committee on Multiemployer Pension Plan Solvency released their draft pension reform proposal. Per the Construction Employers Association (CEA) and the National Coordinating Committee on Multiemployer Pensions (NCCMP) labor/management coalition, "this proposal is wholly flawed, and is being opposed by virtually all groups." Included in those groups is the MCAA and the UA. Per the NCCMP, the initial draft proposal is a very dangerous set of PBGC fee increases, imprudent funding restrictions, and administrative reforms that will imperil the long term sustainability of the current defined benefit model for well-funded plans.   Additionally, the proposal does not include the GROW Act/Composite Plan proposal, which the MCAA and the UA supported. On November 27, M&SCA Executive VP Frank Wall submitted a letter to the committee chairs opposing the proposal . On November 30th, the Committee issued a statement that since consensus could not reached they would not be issuing a report or a legislative proposal before the end of this year.

Construction Technology Expo Recap
On Thursday, November 29, nearly 200 members of the construction industry gathered for the first annual Construction Technology Expo. Hosted by 5 area trade associations (M&SCA of Eastern PA, GBCA, NECA PDJ, AGMA, & EBA) the expo showcased over 20 exhibitors, 2 breakout sessions, and a keynote address from Jay Snyder, Technology Practice Leader of  FMI.
