NIA Legal Counsel Update on the COVID-19 ETS
|
Enforcement of OSHA’s COVID-19 Emergency Temporary Standard (ETS), requiring all employers with 100 or more employees to implement a vaccine or testing policy, had been stayed (i.e., put on hold) while its legality is being challenged. However, on Friday, Dec. 17, 2021, the Sixth Circuit Court of Appeals lifted the stay. That means OSHA can now enforce the ETS. OSHA stated that it will not issue any citations for failure to comply with the ETS before Jan. 10, 2022. The Sixth Circuit’s decision does not impact the federal contractor vaccine mandate, which remains stayed.
