ASK FOR A REP!
If you're selected for drug/alcohol testing, make sure you always request a rep. Not because you think you may fail but because if anything is done wrong in the collection process, we want to make sure you are protected. The refusal to test is a failure. If no rep can be provided (think late swing or mid) that doesn't stop the test. That's where the checklists (below) are the most useful.

The Drug and Alcohol Committee (DAC) advises an employee undergoing substance abuse assessment and evaluation to request in writing a copy of his/her assessment report immediately following the evaluation. Submit the request with the clinician providing the assessment as well as with the Regional Flight Surgeon and/or the EAP Coordinator. DAC encourages the employee to share the information with the NATCA representative(s) working the issue on behalf of the employee.

What a Drug Test Should Look Like
Substance Testing is Contained in 
If the tester is negligent in any of their duties make sure it is noted on the Drug Testing Check list. This is one of the ways that we can get a drug test invalidated.

1.   You (the Facrep or YOUR Designee) should be informed immediately that a Drug and or Alcohol Test is going to take place. Don’t allow management to get away with notifying someone who just happens to be in the union. They call you, you advise them of who you will allow to act in your stead.
2.   You need to advise all of the bargaining unit that they need to request their union rep be present.
3.   You (Facrep or designee) are allowed time with the person being tested. I use the first 10 minutes to look over the checklist with the BUE. The second 10 is used filling out the Drug Testing Check List.
4.   The collector must be the same gender as the donor.
5.  Any and all receptacles must be secured (toilet bowl tanks, toilet paper dispensers, loose floor drains…..) prior to testing. 
6. Toilet bluing agents must be placed in the toilet bowl and the tank if the toilet has one.

UNION REPRESENTATIVE IF REPRESENTATION IS REQUESTED 
7.   The collector must request the donor to present photo ID.
8. The collector must request the donor to remove any unnecessary outer garments.
9.   The collector must direct donor to empty pockets and display all items. A billfold or any money must be returned to the BUE after inspection.
10.  The donor must be directed to wash and dry hands prior to giving sample. After washing hands the donor must remain in the presence of the collector. 
11.  If union representation is requested the representative shall accompany the donor and collector into the restroom (there is no requirement for the union rep to be the same gender as the donor, if it would make the donor more comfortable you can offer to stand outside the restroom until the sample is in the specimen cup and then come back into the restroom prior to the collector doing ANYTHING)
12.   Upon receiving the specimen from the donor, the collector shall determine that it contains at least 45 ml of urine.
13.  Immediately after collection the collector shall determine the temperature of the specimen. The donor should be asked to observe the reading of the temperature and the recording of the reading on the control form.
14.   The collector, in the presence of the donor and the union representative, if requested, must divide the specimen into two bottles.
15.   Both bottles must be sealed and labeled in view of the donor. Both tester and donor must initial each label.
16.  The donor must read and sign a certification stating that the donor provided their urine to the collector and that the bottles were sealed with tamper-­‐proof seals in their presence.
17.   The collector shall not leave his or her work area, even momentarily, without securing the specimens and documentation, unless another collector is remains in the work area.

REPS: Remember that if you are meeting with someone who is a donor no other
bargaining unit member should be with the tester until you return. 

You are the other set of eyes and the corroborating witness to the testing procedures. 
Do not forget to give management an information request for any testing that occurs.
What a Alcohol Test Should Look Like
1. The Facrep or selected designee should be informed immediately that an Alcohol Test is going to take place. I have advised my manager that unless otherwise notified I have no designee. Don’t allow management to get away with notifying someone who just happens to be in the union. They call you, you advise them of who you will allow to act in your stead.
2.   Advise all bargaining unit employees that they need to request their union rep be present.
3.   The Facrep or designee is allowed time (10 minutes before and 10 after) with the person being tested. Use the first 10 min to go over the Alcohol Testing Check List, the last 10 filling out the Alcohol Testing Check List.
4.   There cannot be anyone else in the room beside the tester, Union Rep, management site coordinator and employee being tested.
5.   The REP should request to see the last calibration sticker (write down what is on the sticker and save).
6.   The collector must request the donor to present photo ID.
7.   Prior to the initial screening test, BATs are required to ask the employee if he/she has consumed any food or drink (other than water) or smoked in the past 15 minutes. If the employee has, then a 15 minute wait period will be observed and the BAT will direct the employee not to eat, drink (other than water), smoke, belch or put any substance in their mouth during this waiting period.
8.   An air blank must be tested before each collection of breath, and print the air blank on the breath test result. The results must be 0.00. The collector is allowed two chances to get a 0.00, if they do not get it the second attempt then that machine cannot be used for testing (they can use another machine if they have one available).
9.   Tester must give easy to understand instructions for performing the test.
10.   The tester must show the employee the result on the machine. Then the result must be printed out. If the displayed result and the printed result does not match both the employee and the tester must initial the paper and the test is invalid.
11. If the result is less than .02 then it is considered acceptable unless the person being tested has an abstinence agreement and is in a follow up testing program (.01 or higher for anyone in this situation is considered in violation of the abstinence agreement).
Confirmation Test 
1.   If the result is .02 or greater then a confirmation test must be done. The confirmation test must be done with the same machine and that machine cannot be used to test anyone else until the confirmation test is completed.
2. The confirmation test will be performed no earlier than 15 minutes after the initial test.
3.   Results equal to or greater than .02 but less than .04 will result in the BUE being declared not ready for duty. If this occurs, contact the DAC
(dac@natca.net or call your RVP).
4.   Results equal to or greater than .04 will be considered a failed test. If this occurs, contact the DAC or your RVP.
Actions That Result In An Invalid Test 
1.   In the case of a screening or confirmation test, the sequential test number or alcohol concentration displayed on the EBT is not the same as the sequential test number or alcohol concentration on the printed result.
2.   The BAT conducts the confirmation test before the end of the minimum 15-minute waiting period.
3.   The BAT does not conduct an air blank before the confirmation test.
4.   There is not a 0.00 result on the air blank conducted before the screening or confirmation test.
5.   The EBT does not print the result.
Remember that if you are meeting with someone who is a donor,
unless someone else from the union is in the room with the tester,
no other bargaining unit member should be with the tester until you return.

FAQ's
Is there not a rep that sits outside the collection restroom until drug testing is completed for the day?
  -Representation is available if requested but no, we don't just post someone outside the restroom because they wouldn't be observing the whole process.

What happens when a rep isn't available?
  -That should rarely ever be an issue but if it ever arose and there were any issues w/ the collection process, those issues would be forwarded to the FAA Site Coordinator (usually an OM or FLM) as soon as it happened. The refusal to test is a failure. If no rep can be provided (think late swing or mid) that doesn't stop the test. That's where the checklists are the most useful.

Can a rep be in the restroom after the employee has requested a Union Rep?
  -Yes

Can the same mouthpiece be used for the screen and confirmation test?
  -No

Can the use of a EBT that has been registered something other than 0.00 on an air blank test be used?
  -Yes, Must be 0.00 by second attempt, Order page VIII-10

While the donor is washing their hands, can the collector prepare the test kits just outside the restroom?
  -No
Can you allow someone to remain at work who has a test result of .02 or greater?
  -Yes 0.02 or greater, but less than 0.04, on a confirmation test (except follow up) shall not perform or continue to perform safety-sensitive duties.

A donor that doesn't have their social security card or photo ID, Can the collector /BAT use an alternative method to identify them?
  -Yes

Without trying, can the donor tells the collector that he/she can't provide a sample?
  -No

Can a BAT use a different EBT (evidential breath testing) device for a confirmation test?
  -Yes

Can a collector/BAT ask if you want to use your SS# for identification?
  -Yes - But we advise you NOT to

Can a collector/BAT look through a purse?
 -No

Can a collector/BAT look through a billfold or wallet?
  -Yes

Can a collector allow the donor to leave the room to get a drink of water after the donor has washed their hands
  -No
