On September 4, 2024, Governor Newsom issued a proclamation terminating the drought state of emergency in various counties throughout California, including Orange County, Los Angeles County, Riverside County, San Bernardino County and San Diego County. As a result of the end of the state of emergency, homeowner associations can once again impose fines or assessments against an owner, after a noticed hearing, for reducing or eliminating watering of vegetation or lawns. (Civil Code Sections 4735(c) and 5855(a).) However, as a reminder, homeowner associations cannot require an owner to reverse or remove water-efficient landscaping measures that were installed in response to the state of emergency. (Civil Code Section 4735(e).)
