E-Verify Releases Updated "Right to Work" Poster




On February 26, 2019, the United States Citizenship and Immigration Services (USCIS) and its E-Verify division have updated the mandatory Right to Work poster. Employers participating in E-Verify must replace previous versions of the posters with the updated version.

The redesigned Right to Work poster seeks to better inform current and prospective employees about their legal right to work in the U.S. Most notably, the revised poster adds new text and information that clarifies the legal rights, responsibilities, and protections of employees during the employment eligibility verification process. Additionally, the updated poster now includes the relevant law's code reference, so employees may now read the law that protects legally authorized workers from discrimination based on citizenship status and national origin. The new poster has also removed any unnecessary language to make the posting less confusing for employees. The layout and graphics of the poster have also been changed, and a QR code has been added.

As has been traditionally required, E-Verify employers must display the updated Right to Work posters along with the Notice of E-Verify Participation in a place that is clearly visible to current and prospective employees who will have their employment eligibility verified with E-Verify. The poster must be displayed in both English and Spanish. While some states have specific laws that require employers to use E-Verify, it is primarily a voluntary program in California. Cal Lab Code § 2812. However, employers with federal contracts must use E-Verify and accordingly are required to display the revised Right to Work and E-Verify posting.
