HB 5412 and HB 4600 were both signed by Governor Pritzker on Friday, June 10^th. These new laws are effective immediately and will apply to contracts entered in to after July 1, 2022.

As a reminder, IMSCA removed their opposition to HB 5412 with the adoption of Amendment 3. This amendment contains an exemption for signatories of collective bargaining agreements from the requirements of HB 5412; which states: (g) Primary contractors who are parties to a collective bargaining agreement on the project where the work is being performed shall be exempt from this Section. 

HB 4600 is a trailer bill to HB 5412 and includes the same provisions as HB 5412, but also creates the Bond Reform in the Construction Industry Task Force. The Task Force is charged with studying innovative ways to reduce the cost of insurance in the private and public construction industry while protecting owners from risk of nonperformance. IMSCA is actively pursuing the appointment of an IMSCA member to the Task Force.
