| STATE LEGISLATIVE SESSION UPDATE | PASSED BILL SUMMARIES
The Colorado legislature finished its work on May 11 (a deadline set by law) this month. Take a quick look at some of the energy legislation the lawmakers passed. You can read entire bills by clicking on each link. This marks another landmark year for legislation passed in Colorado that is speeding up the “energy transition” impacting and creating opportunities for EEBC’s energy efficiency members’ businesses.
The 2022 Session of the Colorado General Assembly included a variety of legislation designed to encourage the use of renewable energy, cut carbon emissions, incentivize electrification and add more efficiency to buildings and vehicles.

HB22-1362 Building Greenhouse Gas Emissions This measure will require cities and counties to adopt stronger building codes when they update their rules. It requires the Colorado energy office to identify the language for model codes that will encourage solar-ready construction, encourage low-energy construction and encourage green building. It will also create grant programs to encourage efficient electric heating and appliances and electrification for public buildings.

Colorado Legislature Approves Landmark Energy Codes Bill HB22-1362
Saves consumers money and reduces climate pollution
|

Building Greenhouse Gas Emissions
The bill requires the Colorado energy office to identify for adoption 3-sets of model code language:
- Model electric and solar-ready code language;
- Model low energy and carbon code language; and
- Model green code language.
The bill also requires the director of the office to appoint an energy code advisory board that will identify for adoption 2-sets of model code language:
- Model electric and solar-ready code language;
- Model low energy and carbon code language.
Model Codes Process Flow Chart & Timelines
Outcome: This bill preserved the agreements made with stakeholders in the House but adds a more robust stakeholder process for determining the Electric Ready/Solar Ready Code and the Low Energy and Carbon Code by creating an Energy Code Board to oversee this. SB22-193 Air Quality Improvement Investments This measure provides funding to the Colorado Energy Office for energy efficiency, renewable energy, and electric vehicle programs, including $65 million to buy electric school buses, $12 million for bike programs, and $25 million for the industry to adopt efficiency measures.
SB22-051 Policies To Reduce Emissions From Built Environment The bill provides 10% tax credits for purchases of air-source and ground-source heat pump systems and exempts them from state sales taxes. It also creates tax credits for energy storage systems.
HB22-1249 Electric Grid Resilience And Reliability Roadmap The bill creates a roadmap for improving electric grids in the state. It will include the potential benefits of developing microgrids, potential threats to grid reliability, and recommendations for improvements to facilitate microgrids.
HB22-1218 Resource Efficiency Buildings Electric Vehicles This measure requires commercial and multifamily buildings to include electric vehicle charging capability. The requirements for charging and conduits allowing EV equipment to be installed vary by building size.

UPDATE | Xcel Energy implemented new Heat Pump EER and HSPF requirement level changes from the Heat Pump [May 12th] 60-Day Notice on May 13, 2022. These are now live in the marketplace.
Congratulations to the EEBC HVAC/Heat Pump Action Group and EEBC members who responded with a joint EEBC “member comments summary letter” to the Heat Pump 60-day Notice.
Xcel Energy's response letter addresses the comments. These changes will be posted on the Xcel Energy/PUC website this week and filed with the Public Utilities Commission with the rest of the 60-Day Notices materials with the Q2 2022 DSM RoundTable filing.

Xcel Energy’s ENERGY STAR® New Homes Update
For Participating Colorado Homebuilders and Raters | 2022 Program
Summary
In April the ENERGY STAR New Homes Program processed 969 projects bringing the year-to-date total to 2,156. Approximate program year energy savings are 39,937 Dekatherms and 2,629,256 kilowatt-hours; builder rebates earned a total of $815,530.
Marshall Fire Support Update | Marshall Fire Rebates | LINK
Xcel Energy is offering one-time direct-to-customer incentives specifically to help support Xcel Energy customers who lost their homes in the Marshall Fires.
Homeowners will apply directly to Xcel Energy for these incentives, however, there may be supporting documentation that will need to be provided by the builder or energy verifier.
There will also be a preapproval process that will be optional for projects seeking ENERGY STAR and ZERH certification. However, preapproval will be required for projects seeking PHI or PHIUS certification and rebate. The preapproval application is intended to provide homeowners with a level of confidence that the final project will meet the requirements of the desired certification. Preapproval will also help the ESNH program team identify re-build projects so we can assist throughout the process. These application forms and required supporting documentation will be available later this month. Once released they will be circulated to ESNH stakeholders.
EPA and DOE Training
Thank you to all who attended last week’s ENERGY STAR v3.2 and Zero Energy Ready Homes v2.0 training. Over 90 program stakeholders were in attendance including builders, homeowners, HERS Raters, and other industry professionals. Both pieces of training were recorded and can be found at the links below:

Electrification Pilots | City of Denver
The city is piloting an incentives program for large multifamily and commercial buildings to make efficiency upgrades by early 2023. If you think your building’s natural gas heating equipment will need to be replaced in the next three years, fill out our application to learn more about the program and see if your building might qualify for this pilot project.
Sustainable Neighborhoods | Funding Application
Sustainable Neighborhoods is providing funding for neighborhood-led sustainability projects. Neighborhood- and community-based organizations in the City and County of Denver are eligible to apply for up to $5,000.
Applications will be reviewed on a rolling basis until funds are fully spent. Funds are limited, so apply soon!
Energize Denver: Energy Benchmarking is Due June 3
Buildings 25,000 square feet and larger must submit annual energy benchmarking data by June 1, 2022. With the passage of the Energize Denver ordinance in 2021, buildings must meet annual energy performance targets starting in 2024. Please visit denvergov.org/energizedenver for more information.
