LEGISLATIVE NEWS
● Florida’s Landlord-Tenant Act (Chapter 83) requires all legal notices to be in writing and delivered to the resident (via mail or hand-delivered). Although housing providers already routinely communicate a variety of updates to residents via online portals, text messages, or email, all notices related to landlord-tenant matters must still be served in writing.
● HB 615 (Rep. Esposito) / SB 1164 (Sen. Leek) modernize the notice process and provide privacy to residents by amending state law to allow both residents and landlords to opt in to receiving notices electronically.
● HB 615 was signed into law by Governor DeSantis on April 29th and became effective on July 1, 2025.
Flood Disclosures (SB 948
• Requires housing providers/owners to disclose renters insurance policies do not cover flood damage and also disclose certain flood related information (i.e. flooding events, flood-related insurance claims) to residents before signing a rental agreement for 1 year or longer.
• If a resident was not provided the disclosure and suffers a substantial flood related loss, the resident would be allowed to break their lease without penalty.
• A resident who breaks their lease under the provisions in this bill is only entitled to a refund of previously paid prorated rent after they have fully vacated the unit.
Status: SB 948 was signed into law by Governor Desantis on June 20th and will become effective on October 1 1 2025.
