Ready or not, the heat of summer is upon us (along with cicadas here in East TN). I keep seeing stories where some folks have “tasty” recipes for the cicadas. Everything from cookies, to popcorn to cocktails are being concocted with bugs that have been underground for 17 years! As for me and my house, we’ll take a hard pass on that and stick with burgers, hot dogs, and maybe a steak for our summertime menu.
May was another month with some big events and news. Both of our Big Rigs golf outings were a huge success. The Middle TN event set an all-time record for its donation to the Nashville Ronald McDonald House and the East TN event had its highest fund-raising level in over 20 years for the East TN Children’s Hospital. I can’t thank everyone enough for the hard work to make the events possible and the unbelievable participation and sponsorships.

1-Pager: CARB Clean Idle Stickers for EPA-only Certified Model Year 2022-2023 Engines
Background
· Starting model year 2022, CARB is requiring longer minimum emissions-related warranties
o Medium-heavy on-highway (e.g., Cummins B6.7, L9), from 100k mi to 150k mi
o Heavy-heavy on-highway (e.g., Cummins X12, X15), from 100k mi to 350k mi
· To provide customers with a choice, Cummins has a “two-product” offering for North America
o CARB-only certified products for all engine families sold new in CA or other CA states
o EPA-only certified products for all engine families sold new in non-CA states
· The CARB-only and EPA-only products will be identical in every way, except for the longer warranty—and the higher price for the longer warranty—and the engine emissions label.
Issue
· On Thursday April 29th, 2021, the Truck and Engine Manufacturers Association (EMA) held an all-day Compliance Workshop with EPA and CARB technical staff.
· During the workshop, CARB staff opined—for the first time—that CARB could not approve EPA-only certified products to display the CARB Clean Idle sticker, even if the EPA-only product was identical in every way, except warranty, to a CARB-only Clean Idle-approved product.
· CARB staff’s issue seemed administrative because their concerns were that EPA does not have a Clean Idle standard to enforce, and CARB would not have enforcement authority over EPA-only certified products if an issue arose with compliance with CARB’s Clean Idle standard.
· EMA members offered potential administrative solutions, including engine manufacturers submitting signed affidavits to CARB and EPA, stating voluntary compliance with CARB’s Clean Idle Standard for EPA-only certified products and/or having CARB declare Clean Idle Stickers to be CARB-approved aftermarket “parts” for which CARB does have enforcement authority.
· CARB technical staff recommended that EMA and its members, plus any other impacted stakeholders, reach out to Mr. Allen Lyons (CARB Chief, Emissions Certification and Compliance Division, Office: 626-575-6973, Work Cell: 626-315-6137, allen.lyons@arb.ca.gov) to discuss impacts any potential ways forward.
THIS IS A DRIVER AND FLEET IMPACT ISSUE
· Both CARB-only and EPA-only certified products will be able to operate in all 50 states.
· However, if CARB does not allow EPA-only certified products to display the Clean Idle sticker, drivers of those vehicles must shut down the vehicle’s engine after five minutes of idle in California and other states that honor the CARB Clean Idle Sticker (e.g., PA, WV, TX, see: ATRI Idling Compendium for a compressive list of idling requirements).

The legislature adjourned in early May and looks to return in January of 2022. The legislature began its session in January in the middle of the worst period of the COVID 19 pandemic. Over several months, the legislature did not know for certain what type of schedule would be adopted to conduct its business, pass a budget and adjourn for the year. Fortunately, the legislature was able to proceed forward without interruption and by the end of the session was able to not only witness an improvement in the COVID 19 infections in Tennessee but also witness an unprecedented growth in revenue as indicated by an increase of several hundred million dollars in revenues in April 2021 as compared to April 2020.
This summer we will be busy with fundraising activities and, of course, TTA will always stay active and support those members who have been supportive of the industry over the years. Your support of TruckPAC is always so important and we look forward to seeing your support continue throughout the next several months. With no major study committees set to meet this summer, we will go on a short summer break in regard to publishing a monthly legislative update; however, if an issue arises that we did not anticipate, we will send an update. Once bill introductions begin in the early fall, we will begin updating the newsletter on a regular basis
