Geachte heer van Raak.

Onlangs las ik uw voorstel, om The First Salute van de Andrew Doria door het eiland St. Eustatius t.g.v. de 250 jarig viering van de onafhankelijkheid van de VS, groots aan te pakken.

Dit is geen slecht idee. Een mooie gelegenheid om de wereld te tonen, welke belangrijke rol Nederland gespeeld heeft bij de onafhankelijkheidsoorlog van de machtige VS. Een feit waarvoor Nederland zich terecht op de borst mag kloppen , alhoewel dit de Lage Landen toendertijd geen windeieren heeft opgeleverd. Zo'n herdenking moet tijdig, zorgvuldig en goed voorbereid worden. Daar is inderdaad 7 jaar voor nodig.

Alle belangrijke politici en regeringsleiders moeten tijdig geinformeerd worden om de vieringsdata in hun agenda te zetten , zodat ze dit internationaal gebeuren niet missen. Alvast veel succes toegewenst met de voorbereidingen en ik hoop van harte dat het een geslaagde herdenking zal worden.

Maar.... het feest mag uiteraard niet over de hoofden van met name de Statianen gevierd worden. Eens was "The Golden Rock" een belangrijke inkomstenbron voor de toenmalige West Indische compagnie. Na de plundering en verwoesting door de Engelsen in de 18e eeuw werd , de nu kale rots lange tijd volledig door Nederland genegeerd en aan haar lot overgelaten. Ik weet zeker dat er een herdenkingsboek / - document t.z.t. zal verschijnen, waarin lof wordt uitgesproken over de lange vriendschapsbanden tussen de VS en Nederland en over de belangrijke rol dat dit land politiek zowel als economisch gespeeld heeft in de wordingsgeschiedenis van het land van president Trump. En dit is terecht.

Maar een hoofdstuk over Statia en de prijs die het eiland heeft moeten betalen voor The First Salute, mag er niet in ontbreken. Sterker nog, gaat u nu samen met uw VVD compaan Bosman ook een 7 jarig plan aan de Tweede Kamer presenteren, om het eiland economisch en sociaal tijdig presentabel te maken voor de grote herdenking? Het eiland kan een economische en sociale boost goed gebruiken. Ooit heb ik een voorstel gedaan om het schip de Andrew Doria te herbouwen als jeugdwerkloosheidsproject. Ik heb toen destijds dhr Willem Vos benaderd, bouwer van het schip de Batavia.Naast het verwerven van technische skills door de Statiaanse jeugd, zou dit schip ook als toeristisch trekpleister kunnen dienen voor rondvaarten en voor de jaarlijkse herdenking van The First Salute.

Ik hoop van harte dat het een groots feest wordt niet alleen voor de prominente politieke personages van beide landen, maar ook voor de bewoners van Statia ,die in de eerste plaats profijt moeten hebben van dit heugelijk moment. Dan pas kan gesproken worden van een waar feest.

7-parts series about the Public Prosecutor's Office views on the lead times of investigations
This is a special report brought to you by StMaartenNews.com outlining the views of the Public Prosecutor's Office on the statutes of limitations pertaining to the length of investigations, in particular those of politicians, other public figures and prominent citizens on St. Maarten.

Here is a recap of parts 1 through 7:

In part 1 we discussed the Public Prosecutor's Office and its workings.

In part 2 we discussed how the Public Prosecutor's Office conducts investigations.

In part 3 we discussed that the Public Prosecutor's Office does not work alone when it comes to investigating and bringing criminal cases to trial. It is a part of the criminal justice chain system and each link depends on the other to execute its work properly. So delays on the front-end can have a domino effect on the lead time of a criminal case before judgement is finally executed.

However, the Public Prosecutor's Office has the so-called prosecution monopoly. This means that only the Public Prosecutor can prosecute criminal cases and bring them to court. Individual citizens can not do this. They can file a complaint with the police. Based on an investigation, the OM then decides on prosecution. If the complainant or interested party disagrees with the OM's decision not to prosecute, the interested party concerned can complain to the court. The latter is not very common.

In part 4 we discussed the length of investigations carried out by the Public Prosecutor's Office. Specifically, we wanted to know how long does this actually take in St. Maarten? Unfortunately, no hard data into the lead times of the criminal justice chain exists on St. Maarten.

In part 5 we questioned whether it is allowed for investigations to last so long, whether the so-called "statutes of limitations" exist and are applicable and who checks and oversees this.

In part 6 we discussed the question whether prosecutor-led investigations can't be dealt with faster. The Prosecutor's Office indicated that it always strives to expedite investigations, but that the speed was partly dependent on the capacity of the police force, which is heavily understaffed. The explanation concluded that they are working on an improved registration process to gain insight into the turnaround times. The starting point is modernizing the working methods, modernizing the laws and implementing the use of various instruments to improve effectiveness and efficiency.

In the final part 7 we discussed the question whether the situation surrounding investigations and the length thereof on St. Maarten is the same as in The Netherlands. In principle, the Public Prosecutor's Office stated for the record that in terms of execution and the lengths of investigations there is no difference between the situation in the Netherlands and St. Maarten, even the debates on the duration and speed are the same.
