In an opinion piece in 2016 about the Kadaster situation at the time, Hilbert Haar wrote that there is a good reason why governments are not in the private sector. They would not survive a year in an environment where decisions have to be taken on the double and where failure to do so results in brutal consequences. In the public sector governments have one great luxury the private sector does not have: taxpayers who sigh at such procrastination and simply continue to pay their taxes.

Once again, anno 2018, the Kadaster is headline news. This time it is the notaries that have sound the alarm bell about this dysfunctional government entity that plays a vital role in the island's economy, especially at a critical time of the island's redevelopment in a post-Irma era.

Notaries are by nature very low-profile and publicity-shy. So you must imagine their despair for them to collectively seek out the press to voice their concerns.

What will it take to remedy this situation?

Decisive action is what it will take. From the government side, the Kadaster issue has been bounced back and forth between the ministries of Finance and VROMI like a hot potato. Why actually? What is the big mystery that simple decisions cannot be taken to appoint a full compliment of supervisory board members, a competent Kadaster Director and an equally competent Mortgage Conservator ('Hypotheekbewaarder')?

Note that it regards two distinct functions. In the past, both functions were fulfilled by the then Kadaster Director and now Acting Kadaster Director. But reality has shown that this is a recipe for problems in practice. We hope the relevant stakeholders take the ultimatum of the notaries to heart and take pro-active measures before the deadline so that come Monday, July 16th, the notaries can go back to doing their work in peace.


On behalf of I would like to extend our deepest condolences to attorney Jason Rogers on the passing of his father, Inspector of Police Quintin Rogers.

Our condolences go out as well to the entire Sint Maarten Police Force.

We wish everyone much strength and solace as his family and especially the police force come to terms with this latest loss.
