This year, the state of Illinois ushered in a host of new employment laws, resulting in various modified and new compliance obligations for Illinois employers in 2022 and beyond. In light of these new requirements and protections afforded by Illinois law, we wanted to provide a brief explanation of each of the following laws and how they may impact Illinois employers.
Artificial Intelligence Video Interview Act, amendments effective January 1, 2022
The Artificial Intelligence Video Interview Act (“AI Act”), which was enacted in 2020, placed certain notice, consent, confidentiality and data destruction responsibilities on employers who elected to use artificial intelligence (AI) to evaluate job candidates in Illinois.
One Day Rest in Seven Act, amendments effective January 1, 2023
The One Day Rest in Seven Act (“ODRISA”) requires employers to provide most full-time, non-exempt employees with one day of rest during each workweek, as well as meal and rest breaks during daily shifts.
Victims’ Economic Security and Safety Act, amendments effective January 1, 2022
As of January 1, 2022, the Victims’ Economic Security and Safety Act (“VESSA”) was amended and expanded.
Family Bereavement Leave Act, amendments effective January 1, 2023
Earlier this summer, Governor Pritzker signed the Family Bereavement Leave Act (“FBLA”) into law, expanding upon the 2016 Child Bereavement Leave Act, by providing eligible employees with the right to take up to 10-days of unpaid leave in the event of the death of a covered family member or in the event of certain pregnancy, fertility or adoption related losses. 
The CROWN Act, effective January 1, 2023
Creating a Respectful and Open World for Natural Hair ("CROWN Act") creates a new definition of “race” under the Illinois Human Rights Act, to include “traits associated with race, including but not limited to hair, texture and protective hairstyles such as braids, locks and twists.”
