EEOC Releases Updated
“Know Your Rights” Poster
Employers with at least 15 employees are now required to post the new mandatory Equal Employment Opportunity Commission's “Know Your Rights” poster. The poster, replaces and updates the previous “EEO is the Law” poster. 

Employers must place the new poster in a conspicuous location in their workplace. Employers without a physical location should post an electronic copy on their website. As for employers with a hybrid workforce, whose employees work remotely and on site, they should post both a physical and electronic copy.

According to the EEOC, the “Know Your Rights” Poster includes the following updates:

• Uses more straightforward language and formatting
• Explains that that harassment is a prohibited form of discrimination
• Clarifies that sex discrimination includes pregnancy and related conditions discrimination, such as sexual orientation or gender identity discrimination
• Adds a QR code for employees to access the EEOC webpage
• Provides information about equal pay discrimination for federal contractors

The new posters are available on the EEOC’s website in English and Spanish, and “translations in other languages are forthcoming.”

Failure to comply with the EEOC’s posting requirements can lead to civil money penalties.
