SPEER CEO Todd McAlister and Senior Manager, Policy Engagement Noah Oaks had the opportunity to travel to Oklahoma March 4th-6th to meet face to face with members and stakeholders in the state. SPEER was excited to discuss the ongoing legislative session, Oklahoma Corporation Commission dockets, and tour the Oklahoma State Industrial Training and Assessment Center. In addition to learning about the good work of all our Oklahoma partners, SPEER appreciated the chance to speak with Dr. Hitesh Vora in the ITAC’s Expert Talk Series. Energy Efficiency Rule Review

The Public Utility Commission of Texas (PUCT) Energy Efficiency Division has begun the process of reviewing in its entirety the energy efficiency rules in Texas in Docket 57743. PUCT staff opened an initial public comment period to solicit stakeholder feedback on updated definitions for low-income and hard-to-reach customers as well as a review of cost-effectiveness standards for the investor-owned utility energy efficiency programs. 


The proposed definitions would add a new definition for low-income customers as anyone at or below 80% of area median income. It would also redefine hard-to-reach in the rule as a rural area where the utility is unable to administer energy efficiency programs similar to other areas served. The cost-effectiveness standard had three sets of questions to discuss what changes were needed to the avoided cost calculations, cost-effectiveness calculations, and at what level should cost-effectiveness be considered. 


SPEER, along with several other stakeholders, filed comments for the proposed changes and discussion. SPEER appreciates Commission Staff’s efforts to improve the programs through this rule review. We look forward to continued efforts to reform the rules in their entirety over the course of this year. Regional Legislature Activities

Texas 89th Session:


The Texas Legislature filed 9,987 bills this session, dozens of which either directly or indirectly impact grid operations and resiliency. There are multiple bills filed that seek to improve the utility energy efficiency programs and monitor statewide energy conservation and waste reduction efforts. Several bills will impact building and energy codes, as well as significant focus on renewable energy regulations and building out capacity in the Texas energy resource mixture. Our tracker will be updated frequently throughout session as bills begin to move and we will also provide updates monthly in this newsletter in our “Bills on the Move” section below.

SB 1: General Appropriations Bill, placed on intent calendar 3/20/2025.


SB 6: Relating to electricity planning and infrastructure costs for large loads, passed out of the Senate and received in the House on 3/20/2025.


SB 388: Relating to the Legislature’s goals for electric generation capacity in the state, was passed out of the Senate and received in the House on 3/20/2025.


SB 790: Relating to the procedure for resolving certain customer complaints before the Public Utility Commission of Texas, was passed out of the Senate and received in the House on 3/11/2025.


SB 1252: Relating to the authority of a municipality to regulate the installation or inspection of a residential energy backup system, placed on intent calendar 3/20/2025.

SB 783: Relating to certain regulations adopted by governmental entities for the construction or alteration of residential or commercial buildings, scheduled for public hearing on 3/25/2025.


HB 805: Relating to a study by the Public Utility Commission of Texas on the interconnection of electric transmission service facilities with the United Mexican States, was left pending in committee on 3/12/2025.


HB 912: Relating to the compensation of a distributed renewable generation owner in certain areas outside of ERCOT, was reported favorably w/o amendments on 3/19/2025.


HB 1169: Relating to the adoption of a comprehensive plan to protect oil and gas infrastructure in the state, is scheduled for public hearing on 3/24/2025.


HB 1228: Relating to municipal and county permitting requirements to conduct certain repairs on residential buildings, was left pending in committee on 3/20/2025.


HB 1640/SB 1697: Relating to a customer guide to home solar energy devices, were both left pending in committee.


HB 1710: Relating to certificates of convenience and necessity for the construction, ownership, or operation of facilities for the transmission of electricity, was left pending in committee on 3/19/2025.


HB 1971/SB 879: Relating to an exemption for drillers or operators of closed-loop geothermal injection wells from certain requirements applicable to persons involved in activities under the jurisdiction of the Railroad Commission of Texas, left pending in Senate committee, scheduled for public hearing in House on 3/24/2025.


HB 2152: Relating to a reliability plan for electric transmission service in the Permian Basin, left pending in committee on 3/19/2025.


SB 1202: Relating to third-party review of property development documents and inspections of improvements related to those documents, including home backup power installations, left pending in committee on 3/18/2025.


SB 1376: Relating to the supervision requirements of a code enforcement officer in training, was left pending in committee on 3/18/2025.


SB 2037: Relating to permit application review and contested case procedures for environmental permits involving a project to construct or modify a liquefied natural gas export terminal; authorizing a fee, scheduled for public hearing in Senate on 3/26/2025.

Oklahoma 60th Session:


The 60th Session of the Oklahoma Legislature has commenced! Numerous energy related bills have been filed and are moving through the legislative process. Many of these bills take aim at reducing renewable energy resources in the state, while several seek to aid energy conservation efforts. Bills on the Move:


SB 279: Electric transmission; requiring transmission developer to submit certain application for certificate of authority prior to transmission development. Emergency referred to engrossment on 3/18/2025.


SB 352: Eminent domain; prohibiting use of eminent domain for certain facilities; requiring authorization by Corporation Commission for exercise of eminent domain by certain entities for specified purpose. Emergency was engrossed out of the Senate and had its first reading in the House on 3/12/2025.


SB 460: Natural gas; modifying natural gas energy standard. Effective date. Emergency was engrossed out of the Senate and had its first reading in the House on 3/11/2025.


SB 915: Solar energy; requiring certain commercial solar energy facilities to meet certain standards. Effective date. Emergency was engrossed out of the Senate and had its first reading in the House on 3/17/2025.


HB 1543: Oklahoma Conservation Commission; expanding powers and duties of the Commission; effective date was engrossed out of the House and had its first reading in the Senate on 3/17/2025.


HB 2037: Energy conservation; repealers; effective date was engrossed out of the House and had its first reading in the Senate on 3/6/2025.

Local Policy Updates

Austin: The Austin City Council will host a public hearing on March 27th to receive feedback directly from the community before they vote on proposed code adoption scheduled for April 10th. Technical codes scheduled for consideration include international building code, international energy conservation code, international existing building code, international residential code, and others.
