CANADIAN NAVIGABLE WATERS ACT
Transport Canada’s Navigation Protection Program is conducting a legislative review of the Canadian Navigable Waters Act (CNWA) and invites you to participate.
They are engaging with stakeholders in April and would like to discuss how the CNWA affects your work. They are also interested in hearing any suggestions you may have regarding potential enhancements to the Act or recommendations on refining its implementation.
If you are interested, they will arrange a virtual meeting with a list of discussion questions to guide the conversation. However, your comments on any aspect of the CNWA or its implementation are valuable.
For some contextual information, the CNWA came into force on August 28th, 2019. This legislation employs a regulatory framework to address potential interferences in navigable waters, including works, human-made obstructions, and prohibited activities such as the throwing or depositing of materials and dewatering. As stated in the Act, there is a requirement for a review to be completed before the end of the fifth year after the Act comes into force, which would be August 27, 2024.
You are also welcome to provide feedback on the discussion paper, which is open for comments until May 5. If you have any questions or concerns, please contact them at TC.CNWAreview-ExamenLENC.TC@tc.gc.ca.
