Navigating the Process of Equitable Relief

Equitable Relief is an administrative process made under federal law that allows people with Medicare to request relief from the SSA (Social Security Administration) in the form of immediate or retroactive enrollment into Medicare Part B and/ or the elimination of your Part B premium penalty.

Who can obtain Equitable Relief? The SSA must determine that failure to enroll in Part B is: "Unintentional, inadvertent, or erroneous" and Was the result of "error, misrepresentation or inaction of a federal employee or any person authorize by the Federal Government to act in its behalf." *Example: If you did not enroll in Part B because a SSA representative told you that you did not need to enroll, you may be eligible for equitable relief. Problems with Equitable Relief SSA is not required to respond to your request within any set time-frame and there is not a formal decision letter that they will send to you in response to your request. In the process of Equitable Relief, you have no formal rights and you do not have the right to appeal if your request is denied. It is also not a formal legal process but this should not deter you from filing for equitable relief.

How can you request for Equitable Relief? Write a letter to SSA explaining that you received misinformation from a federal employee. You can call 800-772-1213 to find the address of your local SSA office or visit www.ssa.gov. In the letter, be as specific as you can. Including: Dates/ times you spoke with the federal employee The employees name (if possible) Describe the outcome of the conversation State whether you want coverage moving forward, or retroactive coverage and/or the elimination of your Part B penalty *If you are granted retroactive coverage, you will have to pay premiums back to the time your coverage begins. It is always a good idea to keep copies of the documents you send to SSA and follow up with your local office a month after you submit your letter.

Coconut- Chia Oat Crisps

Ingredients: 1 cup regular rolled oats 1/2 cup oat bran 1/2 cup flaked or shredded coconut 1/3 cup packed brown sugar 1/4 cup whole wheat flour 3 tbsp. almond or peanut butter 1 tbsp. honey 1/8 tsp. baking soda 2 tbsp. chia seeds or flaxseed meal

Preheat oven to 325 F Coat a 15x10 inch baking pan with nonstick cooking spray In a food processor combine: oats, oat bran, coconut, brown sugar, and flour. Process until finely ground. Add nut butter, 2tbsp. water, the honey, baking soda, and 1/8 tsp. salt. Process until combined. Transfer mixture to a large bowl and stir in the chia seeds. Press mixture into pan and bake 18-20 minutes or until golden. Once cooked and cooled, break into pieces and enjoy! *Makes 8 Servings
